part of the fund to any other purpose shall, upon conviction thereof, be subject to a fine of <br /> not more than five hundred dollars ($500.00) in addition to any other penalties prescribed <br /> by law. <br /> 2.64.700 Benefits not Assignable, Subject to Execution, etc. <br /> The benefits payable from the fund provided for by this chapter shall not be assignable, <br /> subject to counter claim, recoupment or set off, nor shall they be subject to assignment, <br /> garnishment, sequestration, execution, injunction or any other decree, order, process or <br /> proceeding in any court for the payment of any debt of the beneficiary and the benefits <br /> shall be held and distributed for the purpose of this chapter and for no other purpose <br /> whatsoever. <br /> 2.64.710 Reserved <br /> 2.64.720 Falsifying Records <br /> Any person who shall knowingly or willfully makes any false statement for the purpose <br /> of securing benefits under the terms of this chapter, or shall falsify, cause or permit to be <br /> falsified, any record or records of such retirement plan in any attempt to defraud, shall be <br /> guilty of a misdemeanor and shall be punishable therefor under the laws of the state, and <br /> all the person's rights, interests and privileges under and by virtue of this chapter shall be <br /> forfeited. <br /> 2.64.730 Proration of Benefits if Funds Insufficient <br /> If at any time hereafter the retirement fund created pursuant to this chapter shall be <br /> insufficient to pay in full all the benefits provided by this chapter to those at the time <br /> being entitled to such benefits, the amount then on hand and available for payment of <br /> benefits shall be prorated among the retirees and beneficiaries so that all retirees and <br /> beneficiaries shall receive the same percentage of their full monthly benefits. <br /> 2.64.740 Reserved <br /> 2.64.750 Limitation of Liability of City <br /> In no event shall anything in this chapter be held or construed to impose upon the city <br /> any duty or Iiability in excess of the funds appropriated for the purpose herein specified. <br /> Restated Nonuniformed Pension Plan—City of University City Page 35 <br />
