Session 1715, Minutes <br />February 9, 1998 <br /> <br />Mr. Schoomer moved approval of the consent calendar. Mr. Wagner seconded the <br />motion, which carried unanimously. <br /> <br />LIQUOR LICENSE - 7555 OLIVE: <br /> <br />Mr. Ollendorff recommended that the application to sell all kinds of intoxicating liquor by <br />the drink at retail during the week and on Sunday be denied since the applicant has not <br />demonstrated ability to act in accordance with all laws, ability to enforce all relevant <br />license regulations and liquor laws, or operate in a manner not injurious to the <br />neighborhood. The burden of proof is on the applicant to demonstrate that the night <br />club will be operated in a manner fully consistent with all laws and not providing police <br />problems or negative influences in the adjacent residential neighborhood. <br /> <br />Mr. Lieberman moved denial of the liquor license. Mr. Munkel seconded the motion. <br />The motion to deny passed unanimously. <br /> <br />501-515 NORTH & SOUTH FINAL PLAT: <br /> <br />Mr. Ollendorff concurs with the Plan Commission recommendation to approve the final <br />plat for consolidating three lots into one for the Manlin Corporation development at this <br />location. All requirements of the City subdivision ordinance have been met. The letter <br />of credit required by the City may have to be increased when final costs of <br />improvements are obtained. It should be noted that all zoning, site plan and other City <br />ordinance requirements remain in effect. This approval is limited to the lot consolidation <br />plat. <br /> <br />Mr. Sharpe moved approval. Mr. Munkel seconded the motion. <br /> <br />Mr. Wagner said that he had received a phone call recently from a constituent whom <br />indicated that the survey with these plats were in question. He asked the City Manager <br />if he knew anything about this situation and if it had been resolved. Mr. Ollendorff said <br />that he had heard about this and that the resident believes that the stakes are in the <br />wrong place. The developer was urged to have the property surveyed and to have the <br />survey included when the building permits are obtained. The burden would be on the <br />developer to make sure that the boundary lines are correct and proper. <br /> <br />Mr. Kenneth Schaeffier, Clayton Engineering, 12755 Olive Blvd., 63141, representing <br />the Manlin Company, said that they had received calls regarding the survey. The lady <br />had noticed a traverse point in her driveway that was set and spray painted. Her <br />property corner is right at ten feet south of the development's southern property corner. <br />There is a ten foot strip of land for a walk way that goes in between the two.
