March 5, 2007
low bidder has a Forestry Certificate, their plan, their hired help are not contracted-
employees, and the City’s Forester is over-seeing the project. Ms. Brot would like to see
a City plan now that the Urban Forestry Commission has all of its appointed members.

Mr. Wagner moved for approval, seconded by Mr. Sharpe, Jr and approved unanimously.

CITY MANAGER’S REPORT
1. Honoring residents, Michael and Matthew McMahon
Recognition was given to two courageous brothers, Michael and Matthew
McMahon, who acted quickly and responsibly in reporting the fire in their house.
By their action, they prevented extreme fire damage to the family’s home and
aided in the family’s safety.

2. Honoring employees:
Battallion Chief Dave Crismon and Police Officer Sheila Riley
Detectives Larry Becton received the Medal of Valor
Detective Marchelli Jamerson; Officers William Linenweber and Neils Dixon
received the Meritorious Service award.

UNFINISHED BUSINESS
BILL 8930
—. AN ORDINANCE OF THE CITY OF UNIVERSITY CITY,
MISSOURI APPROVING AN AGREEMENT WITH AT&T MISSOURI FOR THE
PROVISION OF VIDEO SERVICES IN THE CITY.

CITIZEN COMMENTS
Neil Gilb, Charter Communication Representative
Mr. Gilb stated that Charter felt that competition should be fair and equitable and
require agreements to include regulatory codes If this is equal then let the
competition be market driven. He stated that Senate Bill 829 is the only bill the
Senate is hearing and it looks like it could be passed as early as the end of
August. Mr. Gilb said that it was reported that 25 percent of AT&T’s market
won’t be completed until 2009 – 2010. If this is true, University City would have
already expired two of the first three years of its agreement.

Ms. Brot asked Mr. Gilb what he thought Charter would do if University City
signed a contract with AT&T. Mr. Gilb said that Charter could wait till the
passage of the senate bill since it is on the fast track or they would come back to
the City to amend its current contract.

Mayor Adams asked Mr. Gilb if the new state law would require all video
competitors to abide by the cable regulatory code. Mr. Gilb said it probably
would not.

Ms. Brot asked the City Manager about additional hook-up cost for the City with
the AT&T contract but did not have a dollar figure. At least there is a three year
protection with AT&T contract where it would be none with the passage of the
2
