Session 1818 <br />August 6, 2001 <br /> <br />and mass cannot exceed that shown on plan; lighting must meet codes while protecting <br />adjacent properties; no nighttime trash rernoval; and no liquor license to be granted. <br /> <br />Mr. Schoomer moved the following amendment to add another condition: Hours of <br />operation should be limited to 8 a.m. - 11 p,.m. Mr. Munkel seconded the motion, which <br />carried unanimously. <br /> <br />Mr. Schoomer moved the following amendment to add another condition: No electronic <br />games will be allowed in any of the retail businesses. Ms. Colquitt seconded the <br />motion, which carried unanimously. <br /> <br />Mr. Lieberman moved the following amendment to add another condition: No second <br />hand retail stores be allowed at this site. The condition would be contingent on <br />favorable legal review from the City's zoning attorney. Mr. Wagner seconded the <br />motion, which carried unanimously. <br /> <br />Mr. Schoomer requested that a walkway be constructed at the five foot easement as <br />part of the landscaping plan. Mr. Ollendorff will add it to the landscape and pedestrian <br />plan. <br /> <br />Mayor Adams wanted to make sure the HVAC system was properly sound dampened. <br />Mr. Munkel replied that this issue was discussed thoroughly at the Plan Commission <br />meeting and the problem will be negligible because the system is located in the center <br />of the building. Mayor Adams stated that h,e just wants this to be addressed since this <br />has been a problem for this neighborhood iin the past. <br /> <br />Mayor Adams called the question. All voted Aye to approve the conditional use permit <br />as amended. <br /> <br />RESOLUTION - 6900 BLOCK OF WASHINGTON NEIGHBORHOOD IMPROVEMENT <br />DISTRICT: <br /> <br />Mr. Ollendorff stated that the Council needed to decide whether or not to include the <br />$2,000 for aggregate. The resolution has two figures, one with the $2,000 and one <br />without. We have not yet received the written bill. Mr. Lieberman had asked if this bill <br />could be paid by the subdivision. The trustee says it can, but it was not his preference. <br />Since there isn't an invoice, he would recommend not including it. <br /> <br />The City Clerk read the resolution. <br /> <br />Mr. Wagner moved approval of the resolution to accept $71,653.20, the lower of the <br />two figures, for the construction total for th(; project.
