} <br /> INTRODUCED BY: Councilmember Sharpe DATE: March 14, 2016 <br /> BILL NO. 9284 ORDINANCE NO. 7010 <br /> AN ORDINANCE AMENDING ARTICLE II. DEFINITIONS, <br /> SECTION 400.030 AND ARTICLE V. SUPPLEMENTARY <br /> REGULATIONS, SECTION 400.1460 OF THE ZONING <br /> CODE OF THE CITY OF UNIVERSITY CITY; PROVIDING <br /> AN EFFECTIVE DATE; AND DECLARING AN <br /> EMERGENCY. <br /> WHEREAS, the Zoning Code of the City of University City is intended to be <br /> utilized in conjunction with the University City subdivision and land development <br /> regulations to ensure that the development of land within the City occurs in a manner <br /> that protects, provides for and promotes the public health, safety, convenience, comfort, <br /> and general welfare of the residents of University City; and <br /> WHEREAS, the City Council of the City of University City desires to update <br /> Article II, Section 400.030 of the Zoning Code in order to clarify and alleviate any <br /> vagueness by adopting explicit definitions related to adult business; and <br /> WHEREAS, the City Council has determined that for the health, welfare and <br /> safety of its citizens, amendments are necessary to the Municipal Code of the City of <br /> University City, Article II, Section 400.030 of the Zoning Code with regard to adult <br /> business; and <br /> WHEREAS, the City Council desires to amend Article V, Section 400.1460 of the <br /> Zoning Code in order to provide consistency of the terms utilized and defined in the <br /> Zoning Code and to alleviate any vagueness; <br /> WHEREAS, the City Council has determined that amendments to the Zoning <br /> Code are necessary to establish reasonable and uniform regulations to prevent the <br /> deleterious secondary effects of sexually oriented businesses within the City; and <br /> } <br /> WHEREAS, the purpose and effect of the amendments are neither limiting nor <br /> restricting on the content or reasonable access to any communicative materials, <br /> including sexually oriented materials; and <br /> WHEREAS, the amendments neither restrict nor deny access by adults to <br /> sexually oriented materials or deny access by distributors and exhibitors of adult <br /> businesses; and r' <br /> WHEREAS, the City Plan Commission in a meeting held at the Heman Park <br /> Community Center located at 975 Pennsylvania Avenue, University City, Missouri, on <br /> February 24, 2016 at 6:30 p.m. recommended said amendments of Sections 400.030 <br /> and 400.1460 of the Zoning Code; and <br />
