WHEREAS, due notice of a public hearing to be held by the City Council in the <br /> 5T" Floor City Council Chambers at City Hall at 6:30 p.m., March 14, 2016, was duly <br /> published in the St. Louis Countian, a newspaper of general circulation within said City <br /> on February 28, 2016; and <br /> WHEREAS, said public hearing was held at the time and place specified in said <br /> notice, and all suggestions or objections concerning said amendments of the Zoning <br /> Code were duly heard and considered by the City Council. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> Section 1. Article II. Definitions, Section 400.030 and Article V. Supplementary <br /> Regulations, Section 400.1460 of the Zoning Code of the University City Municipal <br /> Code are hereby amended as provided herein. Language to be deleted from the Code <br /> is represented as stfiGken414raugh, language to be added to the Code is emphasized. <br /> This Ordinance contemplates no revisions to the Code other than those so designated; <br /> any language or provisions from the Code omitted from this Ordinance is represented <br /> by an ellipsis and remains in full force and effect. <br /> Section 2. Article II. Definitions of the Zoning Code of the University City Municipal <br /> Code is hereby amended to revise the definitions related to Adult Business. Such <br /> portions of Article II. Definitions, Section 400.030 of the Zoning Code shall be amended <br /> as follows: <br /> Chapter 400. Zoning Code <br /> Article II. Definitions <br /> Section 400.030. Definitions <br /> ADULT BUSINESS <br /> Any business: <br /> 1. That engages in the sale or rental of merchandise of which a substantial <br /> portion is sexually-oriented material. It shall be presumed that a substantial <br /> portion of the merchandise is sexually-oriented material if any one (1) or more of <br /> the following criteria are satisfied: <br /> a. Twenty-five percent (25%) or more of the floor area of the premises (not <br /> including bathrooms or office space) is used for the storage, stocking or display <br /> of sexually-oriented material at any time; or <br /> b. Twenty-five percent (25%) or more of the merchandise displayed at any time <br /> (by number of items) consists of sexually-oriented material; or <br /> 2 <br />
