Session 1843 <br />June 3, 2002 <br /> <br />Ms. Welsch asked Mr. Wagner if his proposal would be for all Laundromats or just for <br />this location. Mr. Wagner said that this would affect all Laundromats. Mr. Ollendorff <br />concurred. <br /> <br />Mayor Adams commented that if the City Council would have never approved a 24 hour <br />Laundromat ten years ago, then he doesn't believe this issue would be before the <br />Council now. <br /> <br />Ms. Welsch asked Mr. Williams if the ordinance is approved, as it is written, tonight if his <br />client would be willing to move forward and agree to staff approving the 24 hour permit. <br />Mr. Williams said that he will take it back to him. He had strongly advised his client not <br />to go for the 24 hours but to apply for tax abatement instead. It concerns him that he <br />would try to build the building without the funds from the 24 hour operation or tax <br />abatement. <br /> <br />Responding to Ms. Welsch, Mr. Ollendorff stated that the way the City Attorney wrote <br />this ordinance they could make this application at anytime. We would also ask, with the <br />application, how they intend to control against noise, litter and the other conditions. A <br />decision could be given within 24 hours. Mr. Ollendorff also added that he would not be <br />looked on favorably if he would deny permits upon valid applications. Most businesses <br />would prefer to have the staff approve permits than have to go before the City Council. <br /> <br />Mayor Adams confirmed that if this goes to a Council review, then it would require that a <br />hearing be set up which could delay a decision for two to four weeks. A staff review <br />would be much quicker. <br /> <br />Responding to Ms. Welsch, Mr. Ollendorff said he understands full well that an arbitrary <br />decision could be challenged in court. He would have to have some grounds for a <br />denial. In this case, he foresees that his permit officers would be checking with various <br />departments to see if there had been any violations of any of the conditions. If <br />everything checks out, then the permit would be issued for another year. He doesn't <br />see this instance being any more than a routine administrative matter. <br /> <br />Mr. Sharpe suggested that Mr. Williams direct his client to see Mr. Ollendorff once per <br />quarter to review his current standing on how well he is meeting conditions. This could <br />prevent a surprise from occurring at the end of the year. <br /> <br />Mr. Williams said that he would like to see the word "may" changed to "shall" in the <br />ordinance. <br /> <br />Mr. Wagner moved to postpone the reading tonight and to send the bill back to be <br />revised where the City Council will do the initial granting of the permit and staff will <br />review it for the conditions set by Council annually.
