To: Honorable Mayor Adams and City Council

From: Julie Feier, City Manager

Date: July 20, 2007

Subject: Weekly Update

The Task Force on Code Enforcement and Inspections will hold a public meeting
to solicit public input on code enforcement and inspections at Heman Park
Community Center on Thursday, July 26, from 7:00 PM until 8:30 PM.

Kelly mediation
The (not arbitration) did not result in any immediate resolution.
However, we are proceeding with an attempt of global resolution on both the City Hall
and Fire House. Kelly agreed to the original proposal in the fall from the surety, to allow
an alternate contractor, Hankins to serve in the role as project manager. Due to the
large sum already owed sub contractors, over $100,000 on the firehouse alone, I am
not willing to pay over remaining retainage directly to Kelly. We will consider staggered
payments as work progresses, payable to Hankins and Kelly jointly. A related concern is
whether the remaining funds will be sufficient and will be used to complete the work in a
professional manner. In my opinion, if Kelly insists on seeking the $60,000 in
unapproved change orders beyond the contract prices, a complete settlement will not
be possible. I am willing to compromise on the City’s back charges for City Hall, even
though the damage caused by Kelly is well documented. I recognize that some
compromise might be needed if settlement is to be achieved. Hankin, Kelly, and staff
toured both facilities this week with the respective architects. I will continue to keep
Council advised.

Council’s 2008 meeting schedule
The first draft of the is attached. I have identified
the proposed Council meeting dates in bold and highlighted. City Hall holidays/closures
are underlined and conferences are italic in red. I have accounted for the religious
holidays from the previous year. The apparent conflicts are outlined below.
?
March 10: City Clerk Conference & NLC Congressional City Conference
?
April 21: There will be only one meeting in April to avoid Passover or back to
back meetings in May. We will be scheduling additional budget meetings in April.
?
May 19: City Clerk Conference
