Mr. Wagner said that the matter in front of us is to vote on rezoning it or not. He agreed
with Ms. Brot that it would be a great mistake to rezone it. Whether something else can be
done later is not a matter of the bill before us now. Mr. Wagner would so move to defeat
this bill now and was seconded by Mr. Price.

Mr. Glickert asked if the bill was defeated now, would the bill be retooled to go back to the
Plan Commission.

Mayor Adams said that this bill would not go back to the Plan Commission; the issue may
go back but not the bill. Mayor Adams has problems with the comprehensive plan of the
City which calls for “mixed-use” development. He said that this bill is a “mixed-use”
development proposal. Now the Council is saying that we don’t want mixed-use
development. Mayor Adams said the Council should go back to the Comprehensive Plan
and remove “mixed-use” development or go through and mark where “mixed-use”
development is viable and where it is not. Mayor Adams said that the Council had to be
consistent.

Ms. Brot recognized Mayor Adams’ support of “mixed-use” and said that there was a
“mixed-use” development going in a block away from this property, right where it should
be.

Mr. Wagner stated that the Mayor is imposing a strange definition of what “mixed-use” is
and it certainly is not what was meant when several councilmembers suggested it be put
into the comprehensive plan. He said that the project mentioned by Ms. Brot the “mixed-
use” is in the same structure and preferably a new structure. This is not that. It is
embedding a commercial rezoned property into a residential neighborhood, individual
stand alone houses.

The motion was called and passed unanimously.

The motion to defeat and remove the bill from the docket was passed unanimously by
voice vote.

BILL 8907
4. — AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL
CODE OF THE CITY OF UNIVERSITY CITY, MISSOURI, RELATING TO ZONING
DISTRICTS ESTABLISHED PURSUANT TO SECTION 34-22 THEREOF, AND
ENACTING IN LIEU THEREOF A NEW OFFICIAL ZONING MAP, THEREBY
AMENDING SAID MAP SO AS TO CHANGE THE CLASSIFICATION OF
PROPERTY AT 965 MIDLAND FROM "PD" - PLANNED DEVELOPMENT
DISTRICT, TO "LC" - LIMITED COMMERCIAL DISTRICT; CONTAINING A
SAVINGS CLAUSE AND PROVIDING A PENALTY

CITIZEN COMMENT
Eric Schmitt, attorney for petitioner

Mr. Schmitt explained the area location and the improvements that were planned for the
existing property. It will be used as a pediatrician office and a weight loss clinic.

Mr. Glickert moved for approval and was seconded by Ms. Brot.
