<br />combined with the other two lots on Bland which are zoned commercial, one vacant and <br />one with a resident) and become one mega commercial area. <br /> <br />Jean O’Hagan, 7374 Northmoor <br />Mr. O’Hagan encourages the Council to give Mr. Erker a special use permit for a time <br />period. He does not have any objection for Mr. Erker’s use of the property but along with <br />the rest of the residents, he can see the problem of its commercial use in the future. <br /> <br />Gregg Grigaitis, 7253 Northmoor <br />Mr. Grigaitis has been a resident there for 16 years. He stated that there are a dozen <br />children in the block area. Hypothetically the one parcel could merge with the other <br />parcels zoned commercial and would be imminently accessible from Forest Park Parkway. <br />He requested that this zoning not go forward. <br /> <br />Wes Frazer, 7377 Northmoor <br />Mr. Frazer said he was in agreement with all of the previous neighborhood speakers. He <br />said he was the single one trying to move from a larger house in the area to this piece of <br />property. He said that it is perfect for a single person. <br /> <br />Mr. Michael O’Neil sent a letter to Ms. Brot to be read as he was unable to attend the <br />meeting. Ms. Brot said that he confirmed what all of the other residents were saying, but in <br />addition, Mr. O’Neil said that the driveway was below grade and can only accommodate <br />two cars and would make ingress and egress to and from the driveway very difficult. <br /> <br />Ms. Brot commented on the dimensions the U City zoning code requires for General <br />Commercial. The zoning code for General Commercial required a much larger overall <br />dimension than what this property has. She wondered how the Plan Department approved <br />this and later found out that it was passed as a non-conforming use. Therefore, she urged <br />her colleagues to vote against this property being rezoned to commercial. <br /> <br />Mr. Sharpe, Jr., asked Ms. Feier if a variance could be issued for this property. Ms. Feier <br />said that there are variances for allowances but they are considered dimensional. An <br />example would be if a resident wanted to build a deck three feet instead of five feet off <br />your property line, the Board of Adjustment could approve this. There are no variances <br />that could apply to this property. The conditional-use permit is not appropriate here either. <br />Ms. Feier agreed with a comment made by a resident previously that this address is not <br />the only address on Bland; there are more families living in the Clayton part on Bland. Ms. <br />Feier said that this should be put in the file. <br /> <br />Ms. Ricci said she sat on the Plan Commission when this was approved. She said that <br />this was not a non-conforming use but was rather grandfathered in. She said that when <br />she was sitting on the Plan Commission she was not aware nor were the others aware that <br />this was a one way street. <br /> <br />Given the new information, Ms. Ricci moved to deny the rezoning to commercial. Her <br />second alternative would be to kick this back to the Plan Commission to see if they would <br />have a better recommendation to allow the Erkers to do what they wished with their <br />property and then would return to residential. <br /> <br /> <br />
