Session 1854
October 7, 2002

registered with the Secretary of State. The correct name is Lulu Seafood rather than
Lulu's Dim Sum. Mr. Munkel moved to adopt, Ms. Colquitt seconded and the motion
was carried.

AGENDA # 4 PROPOSED CONTRACT TO REPAIR SIDEWALKS & CURBS IN THE
700 BLOCK OF LELAND:

Mr. Ollendorff stated that this matter had been tabled for clarification. It was moved by
Mr. Sharpe to remove it from the table, seconded by Mr. Wagner and carried.

He reported that a year ago, money was set aside to improve curbs and gutters in the
Parkview Gardens Neighborhood, specifically the 700 block of Leland. That money will
be lost if it is not spent and if there was a desire to transfer it to another project, there is
no time to do so. He stated that he still thinks it is a valid project that needs to be
carried out and recommended that Council accept the best bid for that work.

It was moved by Mr. Wagner, seconded by Mr. Sharpe and carried.

The Mayor observed that the lowest bidder, R.V. Wagner, is no relation to
Councilmember Mr. Robert Wagner.

AGENDA # 5: RESUBDIVISION/CONDOMINIUM PLAT FOR 7749 DELMAR:

Mr. Ollendorff stated that this matter involved dividing an existing, two-unit residential
building at 7749 Delmar into two condominium apartments. Since it meets all the City's
requirements, he agreed with the Planning Commissions' recommendation to approve
the project.

It was moved by Mr. Munkel, seconded by Mr. Sharpe. There being no discussion, the
matter was voted on and carried unanimously.

AGENDA # 6: RESUBDIVISIONICONDOMINIUM PLAT FOR 7320 FORSYTH:

Mr. Ollendorff stated that the Planning Commission agreed that all requirements of the
ordinance have been met and were in conformity with plans approved by the City
Council two years ago.

The move for approval was made by Mr. Wagner, and seconded by Mr. Sharpe.

Mr. Lieberman stated that he noticed the trend towards more condo conversions from
rental units. Since Mr. Ollendorff has commented in the past that he looked forward to
these conversions because of the home ownership aspect, Mr. Lieberman asked if he
had found if the City could deal with the occupants as owners directly or did they have
to be dealt with indirectly through the condo association? The City Manager answered
