Session 1854
October 7, 2002

priority among those in attendance. Many people had spoken about the need for
housing and housing assistance; she hoped that these issues would be considered
during next year's funding priorities.

The motion was brought to a vote and was carried unanimously.

AGENDA # 2 LIQUOR LICENSE - 8423/25 OLIVE:

The City Manager stated that he had reviewed an application for a license to sell beer
and wine by the drink at the In Soo Restaurant, 8423/25 Olive. He found that the
applicant, Steven Fung, had owned a restaurant next door to the restaurant for several
years and had done an excellent job of managing it. Mr. Ollendorff stated that there
was no negative information in Mr. Fung's background. The location itself has not been
the scene of any problems nor has the nearby restaurant formerly owned by the
applicant. Since all City ordinance requirements appear to have been met, he
recommended that the City Council consider favorable action on this application. He
also noted that since this location had not been previously licensed, the City Council
has the authority to either give its approval or to schedule a public hearing prior to
voting on the application. Ms. Welsch moved adoption. Mr. Munkel seconded the
motion.

There was discussion. Mr. Lieberman asked if, since this would be a new license, the
applicant was required to have provided food service for at least six months. Mr.
Ollendorff said the Council could waive the six month waiting period if the applicant
could show that he has done a good job elsewhere (in or outside the city). Mr. Wagner
asked if the applicant was present and if he could ask questions. The applicant, Mr.
Stephen Fung, 8423 Olive Boulevard, came forward and Mr. Wagner asked him for his
past experience running a restaurant with a liquor license. It was replied that he had
operated a business next door at 8435 Olive from October, 1994 to May, 2001. Mr.
Ollendorff asked Mr. Fung the total length of his experience and was told 14 years.

The matter was voted on and approved.

AGENDA #3 8224 OLIVE- LULU'S SEAFOOD RESTAURANT:

Mr. Ollendorff stated that this application is for a transfer of a liquor license and was
tabled at the last Council meeting. Mr. Wagner moved to remove the item from the
table. The move was seconded by Mr. Munkel and the motion was carried.

The City Manager said that two questions had been raised by members of Council
regarding this application. The first was whether Chaney's license had lapsed in which
case this would be a new license rather than a transfer. Since Chaney's license had
been renewed January, 2002, it is still an active license which would need to be
transferred to the new owner. The second was a question about the police report which
indicated some issue with state registration. The Council had received the papenNork
showing that the name for the registration has been corrected and the business is now
