RESOLUTION 2016-31 <br /> A RESOLUTION CLARIFYING THE LENGTH OF THE TERM UNDER CHAPTER C.CHARTER OF THE CITY OF <br /> UNIVERSITY CITY,MISSSOURI ARTICLE II. THE COUNCIL AND CITY OFFICERS GENERALLY SECTION 10.VACANCIES <br /> AND THE WARD 1 COUNCILMEMBER ELECTED IN A SPECIAL ELECTION ON NOVEMBER 8,2016 TO FILL THE SEAT <br /> VACATED BY THE RESIGNATION OF FORMER COUNCILMEMBER STEPHEN KRAFT IN ACCORDANCE WITH THE <br /> CHARTER AND ORDINANCES OF THE CITY OF UNIVERSITY CITY. <br /> WHEREAS, the Ward 1 Councilmember seat was vacated on May 27,2016 by the resignation of Stephen Kraft;and <br /> WHEREAS, filling vacancies in the future will benefit from guidance and future candidates for such vacancies can be <br /> provided greater certainty;and <br /> WHEREAS, Chapter C.Charter of The City of University City,Missouri Article II.The Council and City Officers Generally Section <br /> 10.Vacancies in council states,"Vacancies in the council including that of mayor shall be filled within sixty days by the council.Said appointment <br /> shall run to the next April election at which time a successor shall be elected for the unexpired term.In the event the council is unable to agree within <br /> sixty days,then a special election shall be held to fill the vacancy until the next regular municipal election"; and <br /> WHEREAS, the Council was unable to fill the vacant Ward 1 seat by appointment within sixty days and defaulted to a special election to fill that <br /> vacancy,which was held on Nov.8,2016;and <br /> WHEREAS, Chapter C.Charter of The City of University City,Missouri,Article IX.Nominations and Elections Section 66. <br /> Time of elections states,"A regular election for the choice of councilmembers shall be held biennially on the first Tuesday in April in the even <br /> numbered years subsequent to the year 1947. One councilmember from each ward shall be elected at the first biennial election;and the <br /> councilmember-at-large and a councilmember from each ward at the succeeding biennial election";and s' <br /> WHEREAS, The City of University City Code,Chapter 105.Elections,Section 105.010.General Elections defines a regular <br /> municipal election as the first Tuesday after the first Monday in April of even years: <br /> "The general municipal election day for the election of a Mayor and any other elective officers that may now or hereafter be elected by the <br /> City at large, and one(1)Councilmember for each ward,shall be the first(1st)Tuesday after the first(1st)Monday in April, 1998, and the <br /> first(1st)Tuesday after the first(1st)Monday in April every four(4)years thereafter. The general municipal election day for a <br /> Councilmember from each ward shall be the first(1st)Tuesday after the first(1st)Monday in April, 2000, and the first(1st)Tuesday after <br /> the first(1st)Monday in April every four(4)years thereafter";and <br /> WHEREAS,Chapter C.Charter of The City of University City,Missouri Article II.The Council and City Officers Generally Section 5. <br /> Generally states"The council shall consist of seven members,each of whom shall be elected for a term of four years.";and <br /> } <br /> WHEREAS, the term of the seat vacated by former Ward 1 Councilmember Stephen Kraft began on April 28,2014 and did not expire until April <br /> 2018:and <br /> WHEREAS,the term for this same council seat began on April 28,2014 and does not expire until April of 2018;and <br /> WHEREAS, the candidate packets stated"Candidates from any ward shall indicate on their petition for nomination to the Council <br /> whether or not he/she is a candidate for a full four year term or a candidate for an unexpired term";and <br /> WHEREAS, the ballot language for the November 8,2016 Special Election reads,"Unexpired Term Ending April 2017";and <br />
