WHEREAS, the City Clerk did not inform the candidates,either in their Candidate Packet,or by written communication,or at the time of Declaration of Candidacy,that the term of the Ward 1 Councilmember elected in the November 8,2016 Special Election would end in April 2017;and WHEREAS, the ballot language listing the Unexpired Term as April 2017 does not comply with the Charter and was not presented to Council,discussed by Council,nor approved by a vote of the Council before being placed on the ballot for the November 8,2016 Special Election;and WHEREAS, members of Council and the candidates for the Ward 1 Council member seat first learned of the April 2017 date on the ballot when the League of Women Voters published a sample ballot on or about mid-October;and WHEREAS, Steve McMahon was duly elected to fill the vacant Ward 1 seat in the November 8,2016 Special Election;and WHEREAS, the City Clerk published on Dec.2,2016,without the approval of Council,a notice in Missouri Lawyers Media of an April 2017 municipal election that is not in accordance with the Charter. NOW THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF UNIVERSITY CITY,ST.LOUIS COUNTY,MISSOURI AGREES AS FOLLOWS: That the unexpired term for the Ward 1 Council Seat formerly occupied by Stephen Kraft and subsequently vacated on May 27, 2016 ends April of 2018,and that is the same as the unexpired term for which a Special Election was held on November 8,2016 to fill the vacant Ward 1 Council seat in accordance with the Charter and Ordinances of the City of University City. Steve McMahon was elected on Novemeber 8,2016 to fill that unexpired term,which ends April 2018 in accordance with the Charter of the City of University City. FURTHER BE IT RESOLVED THAT THE CITY COUNCIL OF UNIVERSITY CITY,ST.LOUIS COUNTY,MISSOURI AGREES AS FOLLOWS: That the City Clerk is directed not to accept any applications for candidacy and nomination petitions for Ward 1 Councilmember for an April 2017 election;and That the City Clerk is directed immediately to print a retraction of the April 2017 Election Notice in the Missouri Lawyers Media,and any other publication she has placed notice of this election:and That the City Clerk is directed to immediately contact the St.Louis County Board of Elections to remove the election she may have placed on the ballot for April 2017. That the City Clerk shall report to all members of council on or before 5:00 pm on December 13,2016,that the retraction of the April 2017 Election Notice has been caused to be published as directed and all documents and actions with any election authority related to an April 2017 election have been withdrawn.
