Session 1863 <br />December 16, 2002 <br /> <br />SINGLE FAMILY RESIDENTIAL DISTRICTS, AND ENACTING IN LIEU <br />THEREOF NEW SECTIONS TO BE KNOWN AS "SECTION 34-30.5 (2) <br />AND 34-30.5 (3)," BY AMENDING SAID SECTIONS SO AS TO OUTLINE <br />SETBACK AND HEIGHT REQUIREMENTS THAT APPLY TO SINGLE- <br />FAMILY DWELLINGS; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Wagner moved adoption. Mr. Sharpe seconded the motion. <br /> <br />Mr. Munkel is opposed to this bill because he believes it does something that will <br />not be beneficial in the long term to University City and making sideyards 8' <br />instead of 5'. It will require narrower buildings to be built on our 50' lots. He <br />does not believe this is necessary and urges his colleagues to vote against it. <br /> <br />Mr. Wagner said that the intent of this is to control the monster footprint houses <br />that are coming in on small lots. There are very few lots in the City and those <br />have no plat line from which the setback is measured. One area that is terribly <br />impacted by this kind of jagged setback rules is over on Lafon. He believes that <br />this is very beneficial legislation for infill housing going into neighborhoods like <br />Lafon. The 8' sideyard has conditions such that the house has to be so many <br />feet higher than the house next to it. He urges passage for this small step, but in <br />the right direction. <br /> <br />Mr. Sharpe said that a number of individuals came to the Plan Commission <br />meeting in favor of this legislation. He urges support of this amendment. <br /> <br />Mr. Munkel heard what Mr. Wagner said about infill housing, but stated that if we <br />pass this law, it means that it will affect just not infill, but new housing, as well. <br /> <br />Mr. Lieberman wanted to make sure that Mr. Munkel understood that the new <br />structures to be built had to exceed the adjoining structure by more than fifteen <br />feet in order to go to an 8'sideyard, otherwise it is 4'. <br /> <br />The roll call vote was as follows: AYES - Ms. Colquitt, Mr. Wagner, Mr. <br />Lieberman, Ms. Welsch, Mr. Sharpe. NAYS - Mr. Munkel and Mayor Adams. <br />Bill number 8634 passed 5 to 2 and became ordinance number 6405. <br /> <br />BILL 8635 - AMENDING CHAPTER 15.04 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO THE BUILDING CODE, BY ENACTING <br />THEREIN A NEW SUBSECTION OF SECTION 15.04.030 TO BE KNOWN AS <br />"3304.7 TEMPORARY CONSTRUCTION FENCES;" CONTAINING A SAVINGS <br /> <br />l0 <br /> <br /> <br />
