Session 1863
December 16, 2002

the commission that she was on, that they did have to take minutes at all the meetings.
She hopes that this can be rectified to renew our CLG status. She also asked Mr.
Hamilton about his thoughts about how the historic setback could override the tree in
the 201 Westgate issue. Mr. Hamilton said that the tree is only going to last a certain
time, whereas we hope the neighborhood is going to be there forever. The ordinance
establishing the historic district requires the commission to maintain the overall
appearance of the district, and especially in a compact, densely built up neighborhood
like Parkview, the setback is one of the most important things that create that overall
appearance. Ms. Welsch wondered why moving a building into a historic district doesn't
change the district. Mr. Hamilton replied that even if this was a new building, they would
still have to review the design and make sure that it was compatible with the historic
setting.

Mr. Wagner said that he vouches for Mr. Hamilton as being the preeminent historic
preservationist in our City, County and the State. He thanked him for all his services to
the City which has been many and varied. Mr. Wagner stated that he was sitting as
liaison to the HPC the night Mr. Hamilton mentioned. He remembered that the drawings
were not at all correct, as well. The general setback on that street is more than 40'.
The point at the meeting was if a few more feet could save that tree, then let's consider
some flexibility. Mr. Walker agreed to relax the setback from 40' to 46'. It was a valid
point. Mr. Hamilton was not objecting to the result, he is objecting to the process. He
believes that the commission should have made that decision. If he had been chairing
the commission, no decision would have been made that evening, because the
drawings presented were inaccurate. Mr. Wagner insists that minutes are kept and
distributed to the public per State Sunshine Law.

Mr. Munkel has great respect for Mr. Hamilton and he is glad that he is still around and
concerned with preservation.

Mr. Ollendorff said that Lehman Walker prepares minutes of every HPC meeting and
distributes those to all of the members. He prepares them personally. Mr. Lieberman
inquired about minutes of this commission earlier today and he made copies of the
minutes from the last four meetings. Any other distribution can be done. Responding to
Mr. Munkel, Mr. Ollendorff stated that there is no problem with Mr. Hamilton getting
copies of the minutes. Mr. Munkel asked Mr. Ollendorff to check into the CLG status.

CITY CLERKS DOCKET:

BILLS FOR SECOND AND THIRD READINGS:

BILL 8634- AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF
THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY
REPEALING SECTION 34-30.5 (2) AND 34-30.5 (3) THEREOF
RELATING TO BUILDING HEIGHT AND SETBACK REGULATIONS IN
