Session 1863 <br />December 16, 2002 <br /> <br />whether this bill is passed or not, in continuing to try to keep these properties <br />clean. Mayor said that this is what he wants to see done. <br /> <br />There is a substantive change, so this bill should be defeated. Then Council can <br />decide to rewrite it or not and bring it back. <br /> <br />The roll call vote was as follows: AYES - Mr. Lieberman. NAYS - Ms. Colquitt, <br />Mr. Munkel, Mr. Wagner, Ms. Welsch, Mr. Sharpe and Mayor Adams. Bill <br />number 8635 was defeated 6 to 1. <br /> <br />The motion to approve the bill was offered by Mr. Lieberman and seconded by <br />Mr. Sharpe. <br /> <br />Mr. Wagner asked that a new bill be prepared. <br /> <br />BILLS FOR INTRODUCTION: <br /> <br />Mr. Ollendorff said that the Council had a discussion at the last City Council meeting <br />whether or not to permit parking in an alley north of Pershing, between Jackson and <br />Purdue. Subsequently, a bill was prepared and placed on the Clerk's Docket. Upon <br />further study, the City Attorney and he agreed that bill was not in the best interest of the <br />City. Instead, he is recommending two bills. The first one, which is obviously, not in <br />final typed form amends the City Code, the section that prohibits parking in any alley. It <br />amends it to prohibit parking in any alley less than 18' in width. If the Council passes <br />this, then in only alleys known to surpass 18', parking would be allowed. Then in the <br />second bill, then in this sole alley where parking would be allowed, that there be no <br />parking in the fifteen feet at either end or adjacent to driveways. If both bills are passed, <br />only one alley in town would be affected and it would in effect allow parking in that alley, <br />except at the east and west fifteen feet and close to driveways. <br /> <br />1. A bill was introduced by Councilmember Wagner, entitled: <br /> <br />AN ORDINANCE AMENDING CHAPTER 10.44 OF THE CITY CODE, <br />RELATING TO PARKING RESTRICTIONS ON SPECIFIC STREETS, BY <br />REPEALING SECTION 10.44.010 THEREOF, RELATING TO PARKING <br />PROHIBITED ON CERTAIN STREETS AT ALL TIMES, AND ENACTING <br />IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION <br />10.44.010 PARKING PROHIBITED ON CERTAIN STREETS AT ALL <br />TIMES," THEREBY AMENDING SAID SECTION SO AS TO PROHIBIT <br />PARKING AT ALL TIMES BY COMMERCIAL VEHICLES IN THE ALLEY <br />BETWEEN KINGSBURY BOULEVARD AND PERSHING AVENUE, AND <br />NONCOMMERCIAL VEHICLES IN CERTAIN PARTS OF THE ALLEY; <br />CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br /> <br />
