cities cannot exert similar authority over the location and appearance of other utility
facilities. The ordinance accordingly establishes new zoning and police power
regulations, as allowed by SB284, governing the permitting, location, appearance and
2
screening of, and standards for, facilities located on private property.
Conclusion
We believe this ordinance implements all germane aspects of SB284 at the local level. It
preserves the authority left to local governments under the law, and it establishes
procedures and standards by which the location and installation of utility facilities can be
regulated by your municipality. We recommend that you take action to enact the
ordinance, including consideration by your planning commission and a public hearing (to
comply with legal requirements for zoning amendments). Please call if you have any
questions.
2
As for the location and appearance of facilities on public rights-of-way, the City has a rights-of-way
management policy located at Section 12.04.070 of the Municipal Code, which would control.
