MEMORANDUM <br />DATE: October 16, 2007 <br />TO: Members of the Plan Commission <br />FROM: Lehman Walker, Director of Community Development <br />RE: Zoning Code Text Amendment - Addition of Section 34-68 “Placement of Video <br />Facilities on Private Property” <br />Please find the attached proposed addition to the zoning code dealing with the “Placement Of <br />Video Service Facilities On Private Property” and the accompanying memorandum of <br />explanation from attorney Paul Martin to the City Manager. <br />The Plan Commission is being asked to review the aforementioned text amendment to the <br />Zoning Code (not the other mentioned “Video Service Provider Ordinance” which is reviewed <br />only by the City Council). <br />The zoning amendment basically sets forth the permit procedures, setback requirements and <br />other administrative regulations dealing with “service facilities” from video programmers. <br />bolded <br />Staff recommends approval with the following minor changes (additions are ): <br />Director of <br />1) All references to the “Planning Director” shall be changed to the “ <br />Community Development <br />.” <br />2)The definition of “Facilities Permit” shall be modified to state, “a permit granted by the <br />and shall be applied for as a <br />City for placement of Facilities on private property <br />building permit <br />.” <br />3)The first sentence of proposed section 34-68.B.1 shall be modified to state, “Facilities <br />Permits. 1. Any Person desiring to place Facilities on private property must first apply <br />(and shall be applied for as a building permit) <br />for and obtain a Facilities Permit , in <br />addition to any other building permit, license, easement, franchise, or authorization <br />required by law.” <br />FH page 5 <br /> <br />
