AT&T Mobility would pay no legal fee on the back taxes <br />for September, October and November 2007, and class counsel would waive its fee for <br />those three months. AT&T Mobility refuses to pay any more of the municipalities' legal <br />fees. Rather than risk losing the deal over legal fees, and to ensure that the class nets <br />24 months of back taxes, class counsel has agreed not to seek the remaining 5% of the <br />25% fee from the back tax payments on the AT&T Mobility settlement as well. What <br />does this mean for University City? The final approval hearing is set for April 18, 2008. <br />Assuming there is final approval on that day, the protest taxes would be released and <br />back taxes paid no later than June 27, 2008. The amount of back taxes listed in the <br />Settlement Agreement is $784,009, from September 1, 2005 through November <br /> <br />30, 2007. The total, then, is $958,231, for this fiscal year. <br /> <br />Sprint Nextel has proposed a settlement that is essentially the same as the AT&T <br />Mobility settlement. <br />The only notable difference is that Sprint Nextel did not pay any <br />municipality taxes under protest from 2002 to 2005, whereas AT&T Mobility paid 21 <br />municipalities, as discussed previously. The St. Louis County Circuit Court gave <br />preliminary approval to the Sprint Nextel class settlement on the same dates. The <br />amount of back taxes listed in the Settlement Agreement is $816,680, from September <br />1, 2005, through November 30, 2007. November 2007 is an estimate, and may be <br />adjusted later to reflect the actual gross receipts when they become available later this <br />month. The average monthly amount for the 27 months is $30,247($816,680 divided by <br />27). Assuming that average for the remainder of this fiscal year, there should be an <br />additional $181,482(6 months x $30,247)(June 2008 won't be paid until July 2008, so <br />there will only be 6 more payments in this fiscal year). The total for FY ’08 is $998,162. <br />The full agreements are available for review in the City Clerk’s office. Mr. Mulligan has <br />prepared a summary of the litigation as an attachment. <br /> <br />Senior Service Board <br />As of January 1, 2008, the , which had operated a non- <br />emergency medical transportation service for University City seniors, will discontinue <br />service. The City thanks the employees and volunteers for their efforts in the past <br />years for their dedication in serving University City seniors. From now on, St. Louis <br />CORP <br />County’s (County Older Residents Programs) will take over providing non- <br />emergency senior medical transportation with personalized transportation services. All <br />Senior Service Board customers will receive information about CORP and other <br />transportation services available to them. The <br />City also urges citizens to become volunteer drivers for CORP. Consider volunteering today and call or . <br /> <br />RFP for an Information Technology Assessment <br />The City’s Consultant was returned <br />on December 18. Four local and national vendors received the specifications with only <br />one vendor meeting the bidding deadline, and a two others requesting an extension. <br />Notice of the extension will be provided to all vendors requesting specifications. The bid <br />amount was higher than budgeted and staff will be evaluating the bid to determine if the <br />proposed work matches the specifications and supports the higher bid amount.
