Bill No. ____________ Ordinance No. ____________ <br />AN ORDINANCE IMPLEMENTING THE 2007 VIDEO SERVICES <br />PROVIDERS ACT BY ESTABLISHING ZONING REGULATIONS FOR <br />THE PLACEMENT OF VIDEO SERVICE FACILITIES ON PRIVATE <br />PROPERTY AND EXTENDING SUCH REGULATORY AUTHORITY <br /> TO THE PLACEMENT OF ANY UTILITY FACILITIES ON <br />PRIVATE PROPERTY. <br />WHEREAS, <br />the 94General Assembly enacted SB284, codified as Sections 67.2675 <br />th <br />through 67.2714 RSMo. and known as the “2007 Video Services Providers Act,” authorizes the <br />limited regulation of such providers with regard to the location, construction, and appearance of <br />video service facilities on private property, among other things; and <br />WHEREAS, <br /> the Council of University City (the “City”) desires to retain and implement <br />such authority as remains to local governments under the 2007 Video Services Providers Act by <br />establishing zoning regulations governing the location, construction, and appearance of video <br />service facilities on private property; and <br />WHEREAS, <br />the Council of University City further desires to extend the City’s <br />regulatory authority over the location, construction, and appearance of other utility facilities on <br />private property, in addition to video service facilities, to enhance aesthetics and protect the <br />public health, safety and welfare, and to ensure equal treatment of all facility owners under the <br />City’s law; and <br />WHEREAS <br />, the City held a public hearing to consider the merits of this Ordinance, after <br />satisfying all publication and notice requirements established by law, and all persons present at <br />such hearings were given an opportunity to be heard and were heard; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br />Section 1. <br />Article V, Supplementary Regulations, of Title 34, being the City’s <br />Zoning Ordinance, is hereby amended by the enactment of a new Chapter 34-68, entitled Utility <br />Facilities Regulations, to read as follows: <br />Title 34 Zoning Code <br />Article V Supplementary Regulations <br />Section 34-68 Utility Facilities Permits & Regulations <br />Page 2 of 9 <br /> <br />
