Any person aggrieved by a final determination of the director may appeal <br />in writing to the city manager within five business (5) days thereof. The <br />appeal shall assert specific grounds for review, and the city manager shall <br />render a decision on the appeal within fifteen (15) business days of its <br />receipt affirming, reversing or modifying the determination of the <br />director. The city manager may extend this time period for the purpose of <br />any investigation or hearing deemed necessary. A decision affirming the <br />director's determination shall be in writing and supported by findings <br />establishing the basis of the decision. Any person aggrieved by the final <br />determination of the city manager may file a petition for review pursuant <br />to Chapter 536 of the Revised Statutes of Missouri, as amended, in the <br />Circuit Court of the County of St. Louis. Such petition shall be filed <br />within thirty (30) days after the city manager's final determination. <br />Section 2. <br />Any person found guilty of violating any provision of this <br />Ordinance or the chapter created thereby shall be punished by a fine not to exceed <br />$1,000.00, or by imprisonment not to exceed 90 days, or by both such fine and <br />imprisonment, and each day the violation continues shall constitute a separate offense. <br />Section 3. <br />Section 5.04.220 of Title 5, Business Licenses and Regulations, <br />of the University City Municipal Code is hereby amended by the repeal of the following <br />language: <br />“Vending machines, newspapers, per year 6.00”, <br />and the replacement of such language with the following: <br /> “Vending machines, other than news boxes, per year 6.00”. <br />Section 4. <br />It is hereby declared to be the intention of the Council of <br />University City that each and every part, section and subsection of this Ordinance shall <br />be separate and severable from each and every other part, section and subsection hereof <br />and that the City Council intends to adopt each said part, section and subsection <br />separately and independently of any other part, section and subsection. In the event that <br />any part of this Ordinance shall be determined to be or to have been unlawful or <br />unconstitutional, the remaining parts, sections and subsections shall be and remain in full <br />force and effect. <br />Section 5. <br />This Ordinance shall be in full force and effect after its passage as <br />provided by law. <br /> <br />
