B. A news box license may be revoked only after a hearing is <br />conducted by the director. The distributor shall be given at least fifteen <br />(15) days prior written notice of the hearing. The director, after hearing all <br />interested parties, shall make a determination whether one (1) or more of <br />the above referenced conditions has occurred and issue an order supported <br />by the information presented at the hearing. If the news box license is <br />revoked, the distributor may reapply after the expiration of the revocation <br />time period. <br />Section 5.100.070 Miscellaneous Regulations <br /> A. All news boxes located within the public right-of-way prior <br />to the effective date of the amendment shall be licensed and brought into <br />compliance with all provisions of this chapter or be removed by the <br />distributor within ninety (90) days of the effective date of this article. <br />B. If a news box remains empty or the printed material is not <br />changed in accordance with its regular publishing schedule for a period of <br />thirty (30) consecutive days, the news box shall be deemed abandoned. <br />C. The director is authorized to seize any unlicensed or <br />abandoned news box, any news box for which the license has been <br />revoked, and any otherwise non-compliant news box using the procedures <br />set forth in Section 5.04.230; provided, however: <br />(1) If the distributor is known, the director shall provide <br />the distributor (i) with ten (10) days written notice and opportunity to cure <br />before the seizure, and (ii) written notice after the seizure, which such <br />notices may supersede all other notices required in Section 5.04.230; and <br />(2) The director shall hold any seized news box for <br />thirty (30) days, after which the director shall remove any funds from any <br />coin-operated news box. If not claimed by the distributor within that time, <br />the news box may be sold at public auction and the proceeds, including <br />any retrieved coinage, used as provided in Section 5.04.230. If the news <br />box is not purchased at auction, the director may dispose of the news box <br />at the distributor’s cost. News box seizures shall not relieve the distributor <br />from any penalty for violation of this chapter. <br />D. Distributors shall also obtain a right-of-way permit and pay <br />the right-of-way use fee as provided in Section 12.04.070 of the Municipal <br />Code. <br />Section 5.100.080 Appeals <br /> <br />
