INTRODUCED BY: ____________ DATE: _________________ <br />BILL NO.:_________ ORDINANCE NO.: ______ <br />AN ORDINANCE AMENDING CHAPTER 8.12 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO GARBAGE COLLECTION AND <br />DISPOSAL, BY REPEALING SECTION 8.12.220 THEREOF, RELATING TO <br />DELINQUENT BILLS-TRASH COLLECTION STOPPED, AND ENACTING IN <br />LIEU THEREOF A NEW SECTION TO BE KNOWN AS “SECTION 8.12.220 <br />DELINQUENT BILLS-TRASH COLLECTION STOPPED”, THEREBY <br />AMENDING SAID SECTION SO AS TO ESTABLISH NEW REGULATIONS <br />ON THE TERMINATION OF CITY REFUSE COLLECTION SERVICE; <br />CONTAINING SAVINGS AND SEVERABILITY CLAUSES, AND PROVIDING <br />A PENALTY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br />Section 1. Chapter 8.12 of the University City Municipal Code, relating to garbage <br />collection and disposal, is hereby amended by repealing Section 8.12.220 thereof, relating to <br />delinquent bills-trash collection stopped, and enacting in lieu thereof a new section to be known <br />as “Section 8.12.220 Delinquent bills-trash collection stopped”, thereby amending said section <br />so as to establish new regulations on the termination of city refuse collection service; so that <br />said section, as so amended, shall read as follows: <br /> 8.12.220 Delinquent bills-Trash collection stopped. <br /> If the owner of real property fails to pay the refuse collection charges in Section 8.12.200 <br />and the bill becomes delinquent, the city shall terminate refuse collection service for the <br />property. Service that has been terminated shall not be resumed until the delinquency and all <br />penalties and interest are paid or the owner enters into an approved plan with the director of <br />finance to pay said amount, and the owner pays the city a fee equal to the administrative cost to <br />resume service. The director of finance is authorized to waive part or all of the penalties and/or <br />interest on such delinquency. The director of finance is authorized to adopt and promulgate <br />rules and regulations to implement the provisions of this section to secure the intent thereof and <br />to promote the public health, safety, and general welfare. <br />Section 2. The sections, subsections, paragraphs, sentences, clauses and phrases <br />of this ordinance are severable, it being the intent of the City Council to comply in all respects <br />with the Constitution and laws of the State of Missouri. If a court of competent jurisdiction shall <br />adjudge to be invalid or unconstitutional any one or more of said sections, subsections, <br />paragraphs, sentences, clauses or phrases, such judgment or decree shall not affect, impair, <br />invalidate or nullify the remainder of this ordinance and shall be confined to the portions <br />adjudged invalid or unconstitutional. <br />Section 3. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Chapter 8.12, Section <br />8.12.220, nor bar the prosecution for any such violation. <br />Section 4. Any person, firm or corporation violating any of the provisions of this <br />ordinance, shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, <br />Section 1.12.010 of the University City Municipal Code. <br /> <br />
