INTRODUCED BY: ____________ DATE: _________________ <br />BILL NO.:_________ ORDINANCE NO.: ______ <br />AN ORDINANCE OF THE CITY OF UNIVERSITY CITY, MISSOURI <br />REPEALING CHAPTER 8.12 OF THE MUNICIPAL CODE, ENACTING IN <br />LIEU THEREOF A NEW CHAPTER 8.12 RELATING TO SOLID WASTE <br />MANAGEMENT AND DISPOSAL, AND ESTABLISHING COLLECTION FEES. <br />_________________________________ <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI AS FOLLOWS: <br />Section 1. <br /> Chapter 8.12, Garbage Collection and Disposal, of the Municipal <br />Code of the City of University City, Missouri is hereby repealed, and a new Chapter <br />8.12, entitled Solid Waste Management and Disposal and attached as Exhibit A, <br />incorporated herein by reference, is enacted in lieu thereof. <br />Section 2. <br /> The collection fees established in the attached Exhibit B, <br />incorporated by reference, are hereby ratified, established, and imposed as authorized by <br />Section 8.12.200.A of the Municipal Code as enacted pursuant to Section 1 of this <br />ordinance. <br />Section 3. <br />It is hereby declared to be the intention of the Council of <br />University City that each and every part, section and subsection of this Ordinance shall <br />be separate and severable from each and every other part, section and subsection hereof <br />and that the City Council intends to adopt each said part, section and subsection <br />separately and independently of any other part, section and subsection. In the event that <br />any part of this Ordinance shall be determined to be or to have been unlawful or <br />unconstitutional, the remaining parts, sections and subsections shall be and remain in full <br />force and effect. <br />Section 4. <br />This ordinance shall not be construed to relieve any person from <br />any penalty previously incurred by the violation of Chapter 8.12, or any section or <br />provision thereof, nor bar the prosecution of any such violation. <br />Section 5. <br />Any person violating any provision of this Ordinance, including <br />Exhibit A or any provision thereof, shall upon conviction be subject to the penalty <br />provided in Chapter 1.12, Section 1.12.010, of the University City Municipal Code. <br />Section 6. <br />This ordinance shall take effect and be in force from and after its <br />passage as provided by law. <br /> <br />
