The northern portion is occupied by a surface parking lot with eight <br />parking spaces with ingress/egress from McGinnis Alley. <br /> <br /> <br />The current request is for a <br />C.U.P. to allow the operation <br />of a food and beverage <br />establishment in the entire <br />building, a 8,560 gross square <br />foot vacant building in t <br />Core Commercial District. <br />An outdoor patio is proposed <br />in the rear of the building. <br />Non-retail uses, such as a food <br />and beverage establishment, <br />with ground floor frontage on <br />Delmar Boulevard require a <br />C.U.P. <br /> <br />The proposed food and <br />beverage establishment is <br />intended to serve a wide <br />variety of patrons. Interior seating is proposed on two levels of the building with a <br />commercial kitchen area proposed in the basement level. The building envelope will remain <br />similar with the exception of the addition of an elevator and fire escape on the rear side of the <br />building. The proposed hours of operation would be 11:00 a.m. to 12:00 a.m. Monday <br />through Wednesday, 11:00 a.m. to 2:00 a.m. Thursday and Friday, 10:00 a.m. to 2:00 a.m. <br />on Saturday, and 10:00 a.m. to 12:00 a.m. on Sunday. Outdoor seating is solely proposed in <br />the proposed new patio in the rear of the building. <br /> <br />Process Required City Approvals <br />Plan Commission. Section 400.2700.C of the Zoning Code requires that C.U.P. applications <br />be reviewed by Plan Commission. The Plan Commission shall make a recommendation to <br />the City Council for their consideration. A public hearing is required at the Plan Commission <br />meeting. <br /> <br />City Council. Section 400.2700.D of the Zoning Code requires that C.U.P. applications be <br />reviewed by City Council for the final decision, subsequent to the public hearing and <br />recommendation from Plan Commission. In conducting its review, City Council shall consider <br />the staff report, Plan Commission recommendation, and application to determine if the <br />proposed C.U.P. application meets the requirements of the Zoning Code. <br /> <br />Analysis <br />The intent and purpose of CC variety of retail <br />commercial uses, with an emphasis towards the sale of retail goods, dining and <br />entertainment which attracts shoppers from a trade area beyond University City. Per the CC <br />District regulations, any ground floor space with frontage on Delmar Boulevard is limited to <br />retail trade, except through the granting of a C.U.P.
