The Delmar Loop consists of a wide range of retail, restaurant, and entertainment venues. <br />Nearby food and beverage establishments on the north side of Delmar Boulevard include <br />Three Kings Public House approximately 40 feet to the east, while other smaller <br />establishments are located approximately 160 feet west. opinion that the <br />proposed use is appropriate at this location and would be compatible and consistent with the <br />surrounding commercial uses. <br /> <br />The minimum off-street parking and loading space requirements set forth in Section 400.2140 <br />of the Zoning Code do not apply to any reoccupancy of existing buildings or structures in the <br /> Core Commercial District. However, a combination of on-street parking, including <br />parking along the adjacent alley, the municipal surface lot across Delmar to the south and <br />other nearby public parking lots and structures are available to serve the parking needs of <br />customers and employees. The proposed removal of eight on-site parking spaces will be <br />replaced with eight spaces leased from the adjacent municipal parking garage to the west. It <br />not have a negative <br />impact on surrounding properties. <br /> <br />on that the proposed hours of operation are reasonable and appropriate at <br />this location and would not be detrimental to the surrounding area. Outdoor dining is <br />proposed within a proposed new outdoor patio at the rear of the building as opposed to on <br />Delmar Boulevard. Outdoor dining d will require <br />submittal of an outdoor dining permit to the Department of Community Development for <br />review and approval. <br /> <br />Public Involvement <br />A public hearing at a regular Plan Commission meeting is required by the Zoning Code. The <br />public hearing notice for the current proposal was published in the newspaper 15 days prior <br />to the meeting date and was mailed to property owners within 200 feet of the subject <br />property, exceeding the required distance of 185 feet. A sign was also posted on the subject <br />property with information about the public hearing. Any member of the public will have an <br />opportunity to express any concerns by writing in or attending the Plan Commission meeting. <br /> <br />Staff Recommendation <br />Based on the preceding considerations, staff is of the opinion that the proposed food and <br />beverage establishment, as shown on the Site Plan and application materials, is appropriate <br />at this location and complies with the Conditional Use Permit findings of fact as set forth in <br />Section 400.2720 of the Zoning Code.
