Plan Commission.Section 405.380of the Subdivision andLand Development Regulations <br />requires that the Plan Commission shall approveor disapproveofthe Final Plat.No public <br />hearing is required. <br />City Council.As soon as practical after the Plan Commission makes its recommendation, the <br />final plat shall be forwarded to the City Council for its consideration. Upon determination that <br />the final plat is in full compliance with the requirements hereof, the Council shall adopt an <br />ordinance approving such final plat. <br />Analysis <br />Staff determined that theFinal Plat meets all requirements of 405.380of the Subdivision and <br />Land Development Regulations. It is in substantial conformance with theapproved <br />preliminary plat. <br />In its review, as per 405.390.C. Plan Commission is to: <br />1.The Plan Commission shall review the final plat at the meeting scheduled for review <br />of the final plat. The Plan Commission shall make a determination whether the final <br />plat is in substantial compliance with the approved preliminary plat. The Commission <br />shall recommend to the City Council approval or disapproval of the final plat. A vote of <br />disapproval shall be accompanied by reasons for such action in the meeting minutes. <br />2.The Plan Commission shalltake action on the final plat within sixty (60) days of its <br />consideration of said plat. Otherwise, the final plat shall be deemed as recommended <br />for approval by the Commission, except that the Commission, with the consent of the <br />applicant, may extend thissixty (60) day period. <br />Conclusion/Recommendation <br />The proposal meets all Zoning Code and Subdivision Regulation requirements for a Final <br />Plat. Thus, staff recommends approval of the FinalPlatfor the proposed MajorSubdivision. <br />33 <br />Page of <br /> <br />
