Session 1894
August 18, 2003

Mr. Wagner suggested the Council take the extended hour proposal under
advisement and observe the course of Mr. Sedlak's business for two weeks to
determine the nature of the operation. He asked Mr. Sedlak to advise the
Council of the amount of business he expects to conduct in the ensuing time
period. More explanation over the next few months while the Council observes
the business will enable their decision-making.

Mayor Adams asked if the delivery people would work out of the front or the rear
of the building and Mr. Sedlak said he had not studied the site to determine this
issue yet. At his other restaurant locations this is determined by visibility and
safety.

Mayor Adams expressed concern that if delivery people exit the front entrance,
potential customers may think the restaurant is open. Mr. Sedlak agreed this
could be a problem. He added it was probable delivery people would exit the
back because that is where the parking is and that he would need to ensure safe
opening of the rear door to the parking area.

Mayor Adams asked when the business planned to move into the location.
Mr. Sedlak advised that since the current lease expires in November, he plans to
undertake construction November 1, 2003, for a period of four to eight weeks.

Mayor Adams asked if that would result in an opening at the end of December or
the first of January and Mr. Sedlak said yes.

Mayor Adams agreed with the City Manager to take the issue under advisement
to clarify the concept. One laundromat business in the Loop, theoretically open
24- hours, is not considered a completely satisfactory concept.

Mr. Munkel asked if Mr. Ollendorff had any opinion from Loop merchants about
this issue. After discussion, it was noted following Mr. Munkel's question that
other Loop merchants were probably unaware of a new business seeking
extended hours. Mr. Lieberman suggested introducing the topic at a forthcoming
meeting. It was also noted that Mr. Sedlak's restaurant, is part of a nation-wide
franchise which operates under the name of Jimmy Johns, Inc.

Ms. Colquitt moved that the restaurant's closing time be 1:30 a.m. for several
months to allow assessment of its functioning, but Mayor Adams noted that a
motion was already on the floor and since Mr. Sedlak's request was for extended
hours, more information was needed. Ms. Colquitt's motion died for lack of a
second.

Page 5
