Mayor Adams asked that the City Attorney, Mr. Mulligan, explain this bill to the City <br />Council for purposed of clarification. <br /> <br />Mr. Lieberman said that when the bill was introduced, it was said to remove the <br />unconstitutional language based on a recent court case. <br /> <br />Mr. Munkel said the statute was confusing because the terms "sexual conduct" and <br />"sexual contact" were used interchangeably, and he believed the proper term to use is <br />"sexual conduct." Also, the four items listed reflect sexual misconduct as stated in <br />Chapter 566 as first, second, and third degree sexual misconduct. That was changed <br />recently by the Missouri Legislature. <br /> <br />Mayor Adams ordered the bill held over without a reading. <br /> <br />BILL NO. 8672 - AMENDING CHAPTER 2.66 OF THE MUNICIPAL CODE, <br />RELATING TO PLANNING AND DEVELOPMENT FEES, BY REPEALING <br />SECTION 2.66.040 THEREOF, RELATING TO APPLICATION FEES, SECTION <br />2.66.050 THEREOF, RELATING TO BUILDING PERMIT FEES, SECTION <br />2.66.060 THEREOF, RELATING TO MECHANICAL PERMIT FEES, SECTION <br />2.66.070 THEREOF, RELATING TO PLUMBING PERMIT FEES, SECTION <br />2.66.080 THEREOF, RELATING TO ELECTRICAL PERMIT FEES, SECTION <br />2.66.090 THEREOF RELATING TO INSPECTION FEES, AND SECTION <br />2.66.100 THEREOF, RELATING TO OTHER FEES, AND ACTING IN LIEU <br />THEREOF NEW SECTIONS WITH THE SAME SECTION NUMBERS AND <br />TITLES, THEREBY AMENDING SAID SECTIONS TO INCREASE NUMEROUS <br />PLANNING AND DEVELOPMENT FEES TO COVER THE COST OF <br />PROVIDING THE SERVICES; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Sharpe moved adoption, and Mr. Lieberman second the motion. The roll call vote <br />was as follows: AYES: Ms. Colquitt, Mr. Wagner, Mr. Lieberman, Ms. Welsch, Mr. <br />Sharpe, and Mayor Adams. NAYS: Mr. Munkel.
