Session 1902 <br />December 1,2003 <br /> <br />Adams stated that it cost $100 dollars to appear before the Board of Adjustment. Mr. <br />Sharpe then advised that at the Plan Commission meeting there was considerable <br />discussion about this proposed change. It was advised that the change applies to only <br />a few homes, available only in certain areas. As explained at that meeting, homes in <br />the immediate surroundings must be the same. Only if existing homes had a forty-foot <br />frontage could there be a discussion to erect another one with a forty-foot frontage. The <br />Plan Commission agreed to the change after much discussion. <br />Ms. Welsch agreed with maintaining setbacks and said she knows that many properties <br />in portions of her ward, Ward Two, are on lots that could be considered smaller. Then <br />she asked if the proposed change would allow a developer to build a six-family unit in <br />an area where there are currently two-family homes. Mayor Adams advised that <br />question would need to be reviewed by City Council. <br /> <br />Mr. Ollendorff said the Board of Adjustment usually approved additions with setbacks, if <br />all the other lots in the neighborhood are also quite small. The law states that City Staff <br />cannot approve changes. The Board of Adjustment asked that the law be changed. <br />For example, University Place asked to make additions to their backyards, but was <br />denied because their changes were not in the code. It was then determined to change <br />the Code to allow for their desired changes, and change was made by a majority <br />decision of the City Council. Mr. Ollendorff then asked if this proposed change is <br />something needed to slow down construction hold-up or does the City Council want to <br />be co-operative and ease the way for people who want to build an addition to a home or <br />a new home under these very narrow circumstances? He does not favor one way over <br />the other, just wanted to clarify the alternatives. <br /> <br />Mayor Adams declared the public hearing closed at 7:43 p.m. <br /> <br />BILLS FOR SECOND AND THIRD READINGS <br /> <br />None <br /> <br />BILLS FOR INTRODUCTION: <br /> <br />1. A bill was introduced by Mr. Sharpe, entitled: <br /> <br />AN ORDINANCE AMENDING CHAPTER 12.04 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO STREETS AND SIDEWALKS GENERALLY, <br />BY REPEALING SECTION 12.04.070 THEREOF, RELATING TO STREET, <br />ETCL, EXCAVATIONS-GENERALLY; PERMIT; BOND, AND ENACTING IN <br />LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 12.04.070 <br />RIGHT-OF-WAY MANAGEMENT," THEREBY AMENDING SAID SECTION SO <br />AS TO IMPOSE RIGHTS, DUTIES AND OBLIGATIONS ON ALL USERS OF <br />THE CITY'S RIGHTS-OF-WAY; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> Page 4 <br /> <br /> <br />
