<br />Mr. Mulligan stated that there was no legal reason to stop the project and could be in <br />breach of contract and could be liable for the unnecessary and unreasonable delay. <br /> <br />Ms. MacCartney assured Mr. Wagner that the City was looking into instituting a rain <br />garden for mitigation as suggested by MSD and she has found means of funding the <br />majority of it. <br /> <br />Mr. Wagner asked about the statement in the letter from Jenkins and Kling stating that <br />they did not receive city documents they had requested. The City Clerk stated that she <br />provided Jenkins & Kling with all materials the City had including minutes, resolutions, <br />ordinances and the Parks’ Department’s material on Parks’ Commission minutes, <br />construction specifications, lighting specifications, range shack plans, bid documents, <br />irrigation specifications, and the recommendation of the Citizens Financial Advisory <br />Task Force report. It was not required by the City to go to the Plan Commission, so <br />there were not any documents available from that commission. <br /> <br />Mr. Wagner then addressed Mr. Mulligan, asking if he agreed that the City had met all <br />the proper approvals and reviews. Mr. Mulligan said that as it was right then, he felt the <br />City had met all requirements but was not aware of Jenkins & Ling letter prior to this <br />meeting. In quickly reviewing this letter, Mr. Mulligan stated that he did not know the <br />wording of the RSMo stated in the Jenkins & Kling letter and would have to review its <br />wording. <br /> <br />CITIZEN COMMENTS <br />Dan Sherburne, 727 Heman #1 North <br />Mr. Sherburne said he also had talked with Mr. Grimm and stated that Mr. Grimm had <br />told him that a Storm Water Facility Management Report is required. Mr. Sherburne <br />said that Mr. Grimm had also told him a hydrologic study should be done and this study <br />should be done before work began, in order to determine the best practice. <br /> <br />Dr. Ethan Schuman, 8258 Groby <br />Mr. Schuman presented Don Humphrey’s opinion on the wet spring look. He said that <br />Mr. Humphrey stated that with no trees the flow and volume of water would be greater. <br /> <br />Mr. Glickert removed his original motion to suspend work until necessary permits were <br />received. Mr. Wagner also agreed to remove his second to this motion. <br /> <br />Mr. Glickert moved to have the hydrologic study done as quickly as possible with <br />Jacobs Engineering, since it could be done under the present grant and would not cost <br />the City any additional money. Mr. Wagner seconded this motion. <br /> <br />The motion to have the hydrologic study immediately, passed by the majority, with two <br />Nay votes from Ms. Ricci and Ms. Brot. <br /> <br />The meeting was adjourned at 7:45 p.m. <br /> <br />Joyce Pumm <br />City Clerk <br />
