<br />The second part of the meeting was called to order by Mayor Adams at 6:45 p.m. and <br />was to cover the Postponement of a decision on Mr. Glickert’s motion at Council <br />meeting, March 24, 2008. This motion was “that proof of compliance with all storm <br />water management regulations enforced by MSD, St. Louis County and Missouri <br />Department of Natural Resources be submitted before the Council for review as soon <br />as possible. Until review of the required permits and acknowledgement of compliance <br />by the Council, all development construction and environmental modification of Ruth <br />Park is delayed. It was anticipated that such delay would amount to no more than one <br />month.” This motion was seconded by Mr. Wagner. <br /> <br />In addition to Mayor Adams, the following members of the Council were present. <br /> Mr. Byron Price <br /> Ms. Lynn Ricci <br /> Mr. Robert Wagner <br /> Ms. Stefany Brot <br /> Mr. Michael Glickert <br />Mr. Arthur Sharpe, Jr. had an excused absence. <br />Also present was Finance Director/Deputy City Manager Janet Watson and City <br />Attorney John Mulligan. <br /> <br />Ms. Watson briefly explained the permitting concerns and motion that arose at the <br />March 24, 2008, Council meeting. She stated that the staff contacted Missouri <br />Department of Nation Resources (MDNR), submitted the City’s plan and were <br />immediately granted a permit. Ms. Watson said the MDNR focus is mainly on the <br />construction process itself in order to avoid the risk of soil erosion, thus polluting River <br />DesPeres. St. Louis County, Stephanie Leon of the Highway Planning Division said <br />that the County had no permit requirements. In contacting Principal Engineer John <br />Grimm from MSD, the City was informed that no permit was required. However a 2006 <br />MSD Rule change did require the City to submit plans because more than one acre of <br />land was being disturbed. Upon review of the plans the City submitted, Mr. Grimm <br />anticipated recommending a pollution mitigation measure such as a rain garden. <br /> <br />The City Manager provided two firms, Jacobs Engineering and Intuition and Logic, who <br />do hydrological studies and their comments. If the Council should decide to require this <br />study Jacobs Engineering was recommended due to the ability to cover the fees under <br />the current contract and grant. <br /> <br />The City met with Mr. Mulligan to review the City’s commitments regarding the five <br />construction contracts and the primary concern would be breach of contract and any <br />subsequent alleged damages due to lost time. <br /> <br />Delaying the project would be of concern because of leaving the soil exposed for any <br />longer than necessary increasing chance of erosion. <br /> <br />In answer to Mr. Price’s question of what a hydrologic study would provide, the Director <br />of Parks stated that the study would give a direct comparison between what the flow of <br />water would occur without the driving range and what the flow of water would be with <br />the driving range. <br /> <br /> <br />
