November 3, 2008 <br />Ms. Joyce Pumm, City Clerk Re: Application for Conditional <br />City of University City Use Permit P080023 <br />6801 Delmar Boulevard 6300 Delmar <br />University City, MO 63130 <br />Dear Ms. Pumm: <br />At its regular meeting on October 29, 2008 at 6:30 p.m. in the Emergency Operations <br />Center of City Hall, 6801 Delmar Boulevard, the City Plan Commission conducted a public <br />hearing on an application by Felix and Maya Feygelman for a Conditional Use Permit to allow the <br />premises at 6300 Delmar to be used as 1 story retail building with reduced "right-of-way" <br />setbacks. <br />The Plan Commission determined that the evidence presented supports the conclusion that <br />the proposed conditional use: a) Complies with all applicable provisions of chapter 34 of the <br />University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Complies with the overall neighborhood development plan and existing <br />zoning district provisions; and e) Will provide, if applicable, off-street parking and loading areas <br />in accordance with the standards contained in the University City Zoning Code. A motion was <br />made by Mr. Senturia, seconded by Mr. Byrne and passed by a vote of 6 to 0 that the Plan <br />Commission recommends approval of the application for a Conditional Use Permit subject to the <br />following conditions: <br />1. The building and property shall be developed, constructed and maintained in compliance <br />with the plans submitted with the approved application. Color details for building faces <br />should be submitted to the Director of Community Development for review and approval. <br />It shall be the applicants responsibility to obtain those approvals in a timely manner prior <br />ã <br />to issuance of the building permit. <br />2. A detailed landscaping plan shall be submitted to the Director of Community Development <br />for approval, in conjunction with a review by the City Forester.
