Mr. Price was concerned over the thirty day deadline and MSD agreeing that <br />they may have had an oversight knowing people did not get the message and <br />won’t do anything about it.He stated that it was ridiculous to think the resident <br />who backed the creek would go down the embankment to cut down trees and <br />brush growth. Mr. Price said the Council had previously asked MSD to provide <br />MSD’s maintenance schedule of the affected area and they have not seen <br />anything yet. Mr. Price asked Mr. Theerman if the window is closed for flood <br />victims, if they had no way to receive MSD’s communication. Mr. Theerman said <br />the window was closed, October 14, 2008. MSD said they did their best to <br />inform people. <br />Ms. Ricci asked how MSD informed the public of their deadline rules. Mr. <br />Theerman stated that their communications were on their website and through <br />the media. He said it was an oversight that MSD did not communicate the thirty <br />days deadline for citizens to be put on a claims list at the last Council meeting. <br />Mr. Theerman stated that their self insured back-flow insurance policy was <br />written by MSD and had a total coverage of 6.5 million dollars and after that <br />amount is reached it is covered by their policy with Zurich.Ms. Ricci told Mr. <br />Theerman that most houses flooded were not in the 100 year flood plane but <br />rather on the 10 year plane. Ms. Ricci said the City has spent approximately <br />$400,000 in assistance for the City’s flood damage. She agreed that this is <br />bigger than the City and MSD and needs Federal attention. Ms. Ricci said that <br />the City does not need any more band-aids. She admits there is a priority <br />problem area, and also admits MSD is responsible for the River DesPeres. She <br />said she has a court ruling stating that MSD is responsible for the jurisdiction <br />control possession and responsibility. She also invited everyone to attend a <br />seminar at St. Louis University on November 11 at 7:00, “Why the River Keeps <br />Rising and What We Can Do About It.” She hoped the City Manager would keep <br />publicizing it. <br />Mr. Price asked MSD to extend the thirty-day window. Mr. Theerman said he <br />could not. Mr. Price asked MSD for proof of the attempt they made to provide <br />the residents of the thirty day limitation. Mr. Theerman said they could provide <br />the media program they supplied. MSD assumed that they had everyone signed <br />up who were victims of the flood and sewer back-up. Mr. Price asked if the <br />blockages in the channel are cleared by MSD. Mr. Theerman said they have <br />already been through the creek and found eight minor blockages and have <br />cleared six of them. <br />CITIZEN COMMENTS <br />Elnora Robinson, 1061 Wilshire <br />Ms. Robinson asked MSD what if the water was coming up in the basement before the <br />water started to come through the basement windows. She stated that she had waste <br />in the basement and it did not come from the overland flood. <br />Richard Dockett, 6844 Crest Ave. <br />Mr. Dockett said he was a member of St. Louis Concerned Taxpayer Group. He <br />claimed it was MSD’s negligence for the two deaths that occurred during the flood. Mr. <br />Dockett stated the he is present for victims that now have snakes in their house and <br />another with mold causing children’s illnesses. He spoke of his Representative Marie <br /> <br />
