Session 1915
March 29, 2004

AGENDA ITEM #5 - 7200 Balson Laundromat Hours

The Council has received a request for 24-hour operation of the Laundromat at this
location. City ordinances spell out that Council may grant such request if you can
conclude that there will be no noise or nuisance to the adjacent residential
neighborhood and upon the condition that residents within 100 feet of the Laundromat
approve the request. The application therefore appears to be in order and can be acted
upon by the City Council.

Mr. Ollendorff reported that currently, the ordinance requires closing at midnight, and
that recently Council amended the ordinance to allow any laundromat the opportunity to
apply for 24-hour permission, upon showing that a majority of the residents within one
hundred feet were not opposed to the request. The petitioner has submitted to you the
signatures of a number of residents and asks that you approve the request.

Mr. Munkel moved approval, and Ms. Welsch seconded the motion.

Mr. Munkel pointed out that this lanudromat was open, illegally, for a number of years,
and when it was required to close at midnight, a number of citizens contacted him,
requesting that it remain open. He now asked the City Manager if there have been any
complaints about this business remaining open after midnight. Mr. Ollendorff said he
did not recall any complaints, and if there had been many, he would remember.

Mr. Lieberman recalled the original discussion of "moving to that majority business", and
it occurred to him that people who live within one hundred feet constitutes a clientele
that changes over a period of time, and he wonders, what kind of protection would be
provided for other residents moving in over a period of time, who many not want the
extended hours. Mayor Adams said these new residents would see the business,
operating successfully, and would not take issue with it. Mr. Munkel said we must
remember we are becoming a 24-hour society and many university students require
unusual hours for doing laundry, and approval of this measure provides that option. Mr.
Ollendorff said the Assistant City Manager reminded him that a proviso in the recently-
passed ordinance allows for the City Manager to hold up prior-year license, if untoward
noise problems occur. He mentions this now to demonstrate there is a small amount of
protection for the City to use in the case of a bad situation.

The measure passed unanimously.

Historic Preservation Architectural Services - Sutter Meyer House

The Historic Preservation Commission recommended that an architect be contracted to
prepare detailed plans and cost estimates for rehabilitating the Sutter Meyer house so
that it can be utilized as a private residence. He concurred with this recommendation as
to the ultimate use and request approval to employ an architect with historic
Page 10
