Ms. Welsch asked why we do not take advantage of the twenty year rate, if <br />there is an option of "getting out without a penalty," despite the length of the agreement. <br /> <br />Mr. Wagner suggested that ten years is a good compromise. It has a great advantage <br />over the year-by-year contracting currently undertaken, and which has an even higher <br />rate of $32.00 per ton. One point he does not agree with is the insistence by Weber <br />upon "... the 3.5 per cent or the CPI, whichever is greater", which he finds exorbitant. <br />He asked the City Manager if he tried to negotiate a more favorable amount. Mr. <br />Ollendorff said that they did not, but that he will, if the Council so desires. Mr. Wagner <br />said he would like that negotiation to occur. The City Manager said the Council could <br />add that provision to the motion, authorizing it, subject to negotiating a different annual <br />adjustment. <br /> <br />Mr. Wagner then moved to amend the motion to negotiate a more favorable annual <br />increase, changing the words "whichever is greater" to "whichever is lower." <br /> <br />Mr. Munkel asked if the City currently pays $37.00 a ton for tipping fee, and was <br />advised that currently the City has no annual contract and the amount is $34.16 per ton. <br />The City Manager said he was not sure if this included the special State and County tax, <br />and indicated that in the current contract under consideration any change in State and <br />County fees would be over and above the 3.5 per cent. Mr. Munkel asked if this means <br />there will be a continuous price for ten years, starting lower than we are currently <br />paying, but increasing over the year. He also wondered if the land fill to be used might <br />be filled up in ten year's time. He thinks the proposal looks like "a good deal for the <br />City." Mayor Adams responded that he understood the land fill would be "good for the <br />next fifty to seventy years." <br /> <br />Mr. Sharpe asked if this proposal proved to be a good deal, if an additional amount of <br />time could be negotiated after the City was five years or so into the current agreement. <br />Mr. Ollendorff said he would have to have the City Attorney review the contract to <br />determine if there is such an option. <br /> <br />Mayor Adams said the original motion was moved and seconded, and asked for a <br />second to Mr. Wagner's motion to amend the original motion. Ms. Welsch seconded <br />the motion to amend. <br /> <br />Mr. Ollendorff said the amendment to the original motion was to negotiate a more <br />favorable cost of living increase, if possible. <br /> <br />The motion to amend the motion passed unanimously. <br /> <br />A vote was taken on the original motion, now amended, which passed unanimously. <br /> <br />Page 9 <br /> <br /> <br />
