Session 1916
April 19, 2004

When they actually computed the quantity, it was three times the estimate. He said he
did not know why the computation took two months to complete, but the final
computation was correct and the amount was accurate and in keeping with the contract.

Mr. Wagner, noting the City Manager's explanation, moved to accept the bill, but issued
a caveat to keep in mind what this company has done to the City when future business
with them is under consideration. Ms. Welsch seconded the motion.

Then Ms. Welsch commented that she hopes EDM would be more specific, in the
future, as to why costs had tripled. Some details submitted were very complete, while
others relating to the tripling of the costs, were not very complete. She prefers that
more specific information be provided in future negotiations.

The motion passed unanimously.

Rehabilitation of Alley between Roberts and Raymond

The tabulation of bid proposals for the above named project is as follows:

1. R.V. Wagner, Inc. $24,135.00
2. Midwest Mudjacking Construction, Co. $31,844.00
3. J.R.W. Construction Company $38,837.00

Mr. Ollendorff pointed out that R.V. Wagner, Inc., is not a relation to Councilmember
Robert Wagner, and he recommended that his project be awarded to them for their bid
of $24,135.00, subject to Cit Council approval of special tax bills.

Mr. Sharpe moved to adopt and Ms. Welsch seconded the motion.

Mr. Wagner said that he had requested this item to be removed from the Consent
Calendar to allow discussion. He wanted to establish, clearly and exactly, that
Councilmembers Sharpe and Colquitt were in agreement with this proposal, and that
residents involved understood how the expenses will be distributed. He wanted to
affirm that everyone is indeed read to proceed with this project. Mr. Sharpe responded
that while residents "are not happy" they "are ready to move forward with the project."
Some citizens are reluctant to have to pay eight per cent interest, but do want to
proceed with the project.

Mr. Wagner then asked if the sum for the repairs will be evenly distributed amongst the
residents, and Mr. Sharpe responded that it would be, and that this had been agreed
upon by the residents.

The motion passed unanimously.

Page 8
