Session 1927 <br />June 28, 2004 <br /> <br />Ms. Brungardt commented upon the process, noting there were "disconnects" she found <br />disconcerting. She thought "Tim Michel's contributions were not responded to in the <br />most productive way possible," pointing out these observations were those of a citizen <br />attending meetings, as she was not an elected member of the City Council at the time. <br />She said she did not follow the progression of one bid to the list of several bids. She <br />also asked why the City Council wore Jacobs's hats at the "Snip Dig" prior to awarding <br />the contract for the recreation center building, and was advised they were provided for <br />the "photo op." and that the cost was covered by their fee as the design company. She <br />asked if Jacobs represented "the one bid" and was advised that they are the engineer- <br />architects, not the construction company. BSl is the construction company, not Jacobs, <br />and they reduced their original bid from $6.2 million due to allowing them more time to <br />compile the bid, allowing them more time to actually construct the building, and reducing <br />the penalty for non-compliance. Mr. Ollendorff said there were minor changes in the <br />specifications: deleting the landscaping in favor of University City in Bloom, and there <br />will be a few more. After the contract is approved, other changes will be negotiated and <br />could include some of Tim Michels' suggestions. Next, Ms. Welsch asked how much <br />time there was to award the bid, and was advised it is about thirty days. Ms. Welsch <br />made several points expressing her opinions about the delay leading to a better facility <br />and the beneficial nature of the Proposition K committee contribution. Ms. Welsch <br />believes that delaying the project is not as negative as Mr. Ollendorff asserts; it can only <br />benefit us because we can be certain that all avenues have been explored and will be <br />included in a new recreation facility that we all can be proud of. <br /> <br />Ms. Brungardt asked what K&S offered, besides a Iow bid, that made them desirable, <br />and she was advised it is their excellent reputation and their good reports on recent <br />jobs, quality as well as price. Mr. Ollendorff only expresses positive aspects, never <br />negative, at public meetings. <br /> <br />Ms. Welsch requested that on any future building expansions, such as city hall, or on <br />the extension of the fire station, or any other building we are doing in the future, that <br />LEEDS be brought in and discussed and Council receive numbers at the beginning. <br />She will vote against this bid in hopes that the measure will be held over, discussed at <br />the next meeting, after input from Tim Michels. She is not ready to sign this contract <br />and does not see the need to do so tonight. There are more questions that need to be <br />answered. <br /> <br />The issue of attending a meeting and voting by telephone was raised, and Mayor <br />Adams said that Councilmembers may listen to a meeting, but not vote, according to the <br />Deputy State Attorney. A new law stipulates participation in the debate is allowed, but <br />voting by telephone is not. A telephone vote is not possible according to open meeting <br />law, unless an emergency exists and the Council votes to allow it.
