Session 1717, Minutes 6 <br />March 16, 1998 <br /> <br />AGENDA #5: CONDOMINIUM SUBDIVISION - 7331 FORSYTH: <br /> <br />The Plan Commission recommends approval to subdivide the apartment building at this <br />address into condominiums entitled "Beacon Place." The applicant has submitted all <br />necessary certificates and verifications therefore Mr. Rose concurs in the <br />recommendation that Council grant final approval. <br /> <br />Mr. Schoomer said that it was his understanding that if the statutory requirements are <br />met then Council has no option to approve. <br /> <br />Mr. Schoomer moved approval. Mr. Wagner seconded the motion. <br /> <br />Mr. Lieberman asked the applicant, Mr. Steve Barron of 1722 Olive, what his plans <br />were with the current occupants of the building. Mr. Barron replied that the building was <br />currently unoccupied. <br /> <br />The motion carried unanimously. <br /> <br />AGENDA #6: CONDITIONAL USE - 6950 OLIVE: <br /> <br />Mr. Rose recommends approval of a Conditional Use Permit for a carry-out restaurant <br />with drive-thru facility as long as a series of conditions are included. The Plan <br />Commission recommends approval. The applicant has submitted a revised site plan <br />which incorporates a number of important conditions including installation of an earth <br />berm along Olive, maintaining the existing fence, adding brick to the front and side <br />elevations and limiting egress onto Olive. The applicant has agreed to all of the other <br />proposed conditions including regular litter removal, providing trash containers, odor <br />control exhaust system installation, revising signage to comply with zoning restrictions, <br />no change to driveways without Council approval, concrete curbing, detailed landscape <br />plan, screening mechanical equipment, and limiting operations to the hours between <br />6:00 a.m. and 1:00 a.m. The applicant has accepted several conditions in order to <br />demonstrate their willingness to work with the residential neighbors to protect against <br />any adverse consequences. <br /> <br />Mr. Lieberman moved approval. Mr. Sharpe seconded the motion. <br /> <br />Mr. Dennis Wozniak, 7700 Bent Branch Dr., Irving, Texas, represents the applicant, <br />Foodmaker, Inc. the parent company of Jack In The Box Restaurants. At the last Plan <br />Commission meeting he met with surrounding neighbors to discuss their proposed <br />hours of operation and other concerns. The Police department did not see a problem <br />with their operation hours being extended on the weekends. Foodmaker's <br />understanding was that Schnucks was open twenty-four hours, but that was not correct. <br />He had indicated to some concerned neighbors, earlier that evening, that they would <br />like to operate the drive-thru a little later than 1:00 a.m. on Friday and Saturday <br /> <br /> <br />
