Session 1717, Minutes 7
March 16, 1998

evenings. The neighbors were told that if there ever was a problem to come up as a
result of the later hours, then the earlier hours would immediately be instituted. As it
stands, Foodmaker, Inc. agrees to all of the conditions, but would like to ask for
additional time on Friday and Saturday nights, for example 2:00 to 3:00 a.m.

Mr. Ware said that the neighbors of the Roth and Bartruer areas indicated their
preference for a closing time of 1:00 a.m. Schnucks, Hollywood Video and other stores
are closed well before 1:00 a.m. Mr. Ware does not see any reason for allowing the
restaurant to stay open to 2:00 - 3:00 a.m. Mr. Wozniak responded that the Hollywood
Video does stay open until midnight or 1:00 a.m.

Ms. Joan McCormack, 6920 Bartruer, believes Jack In The Box has met their criteria,
with one exception. They would like for them to close at 1:00 a.m. seven days a week.
They do not wish for their request to extend their hours on Friday and Saturday nights
to be approved.

Mr. Sharpe wanted to make sure that the recommended hours were set as stated in the
documentation presented Council - 6:00 a.m. to 1:00 a.m. The Mayor confirmed that
the hours as recommended in the documentation is correct.

Mr. Lieberman wished to commend the developers for making an outstanding effort in
meeting and agreeing to a large number of conditions. It is obvious they want to be
good neighbors.

Mayor Adams wanted to make sure that Mr. Wozniak understood, that if there was a
change in the Schnucks' operation times, that they could come back and ask for
modifications.

Mr. Sharpe wished to commend the Foodmaker organization for making the effort to
meet with the neighbors prior to this Council meeting, which was very helpful in
satisfying their concerns.

All voted aye, except for Mr. Munkel who voted Nay. The motion passed 6 to 1.

AGENDA #7: LIQUOR LICENSE - 8159 OLIVE:

A new operator for the 7-Eleven store requests that the license to sell beer only by the
package be transferred. The background investigation reveals no problems with the
applicant and no liquor related problems in recent months at the location. City Council
may approve this application since it meets all requirements of City ordinances.

Mr. Sharpe moved approval. Mr. Munkel seconded the motion.
