Session 1717, Minutes 8 <br />March 16, 1998 <br /> <br />Mr. Lieberman said that this location has been an eyesore and a problem for the <br />neighbors in this area. The problems emanate from the parking lot not being cleaned <br />up properly, loitering and the selling of individual bottles of beer rather than packages of <br />beer, etc. Conditions should be added to this to ensure at least the outdoor cleanup of <br />the area and no loitering in the area. They can put up signs - it is a private lot. They <br />can enforce any kind of rules they want to enforce. He does not mean that they should <br />not have a license, but he does want them made aware of their obligations, as well. <br /> <br />Mr. Schoomer is sympathetic to the problems that this location has generated in the <br />past, however, there is no way in the world we can put any condition whatever upon the <br />sale of liquor and there is not a site plan before us. <br /> <br />Mayor Adams asked Mr. Rose to make sure and convey to the applicant the Council's <br />concern on the cleanliness and loitering problem at that location. <br /> <br />All voted aye, except Mayor Adams who voted Nay. The motion passed 6 to 1. <br /> <br />AGENDA #8 - LIQUOR LICENSE PUBLIC HEARING: <br /> <br />A new application has been submitted for a full liquor license at 7555 Olive Street <br />Road. The required plan and references have not yet been received. The next step is <br />for the Council to set a public hearing on March 30 at 7:30 p.m. The City code indicates <br />that City Council may determine who should be notified of this hearing. The public <br />hearing is the appropriate time to entertain discussion of this matter rather than doing <br />so at this meeting. <br /> <br />Mr. Schoomer asked if there is not an application before Council, if it is appropriate to <br />set a public hearing. Mr. Rose said that the application had been submitted. Mr. <br />Schoomer responded that the application was not complete, which Mr. Rose agreed. <br />Mr. Schoomer said he did not mind waiting another month. <br /> <br />Mr. Sharpe asked what items of information was not complete. Mr. Rose responded <br />that they were waiting for a site plan and references. Mr. Lieberman asked if they <br />provided signatures. Mr. Rose said that this was optional, but that the applicant did <br />provide signatures. Responding to Mr. Sharpe, Mr. Rose said that the applicant will be <br />made fully aware of all items missing from the application. <br /> <br />The sense of the Council was to not act on this issue until a full application was <br />completed and reviewed. <br /> <br />Mayor Adams said that there was a previous application submitted in January and the <br />one dated in February. He asked Mr. Rose to make a distinction between the two and <br />inform Council what the differences between the two applications were. <br /> <br /> <br />
