Session 1718, Minutes ! 7 <br />March 30, 1998 <br /> <br />DEVELOPMENT PLAN PROCEDURE, AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS SAID REPEALED SECTION WAS KNOW, THEREBY <br />AMENDING SAID SECTION SO AS TO PROHIBIT ANY MODIFICATION OF A <br />DEVELOPMENT PLAN FROM RESULTING IN AN INCREASE IN BUILDING HEIGHT; <br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Ollendorff said that this was a reasonable clarification. In the zoning ordinance, <br />once the Council approves a development plan, then that has to be followed and <br />carried out unless the applicant comes back to the Plan Commission and City Council <br />for a change. This clarifies that the type of change that would trigger having to come <br />back again is if you add another story or increase the height of the building, which <br />constitutes a major change. <br /> <br />Mr. Wagner said that it was clearly an oversight that height was left out of the language <br />in the same paragraph that talks about not coming back and increasing the footprint or <br />density. The height should definitely be there. <br /> <br />Mr. Wagner moved adoption. Mr. Schoomer seconded the motion. The roll call vote <br />was as follows: AYES: Mr. Sharpe, Mr. Ware, Mr. Wagner, Mr. Lieberman, Mr. <br />Schoomer, Mayor Adams. NAYS: Mr. Munkel. Bill No. 8377 became Ordinance No. <br />6159. <br /> <br />BILL NO. 8378 - AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br />UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING SECTION 34-40.7.4(B) <br />THEREOF, RELATING TO PLANNED DEVELOPMENT DISTRICTS - DENSITY AND <br />DIMENSIONAL REGULATIONS AND PERFORMANCE STANDARDS, AND <br />ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS SAID <br />REPEALED SECTION WAS KNOWN, THEREBY AMENDING SAID SECTION SO AS <br />TO REQUIRE THAT CERTAIN INCREASE IN MAXIMUM SITE COVERAGE BE <br />APPROVED BY A TWO-THIRDS (2/3) VOTE OF THE CITY COUNCIL; CONTAINING <br />A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Wagner moved adoption. Mr. Ware seconded the motion. <br /> <br />Mr. Lieberman wished to raise his objection to requiring a 2/3 vote of councilmembers <br />to approve site coverage bonus of this nature. He is particulary against any form of a <br /> <br /> <br />
