Simple majority is sufficient. <br /> <br />Mr. Wagner said that this was discussed and approved by the Plan Commission. This <br />is not the first place in the zoning ordinance requiring a 2/3 vote. <br /> <br />Mr. Munkel said that Mr. Wagner is correct, but the language contained in this <br />ordinance is not the same as the other sections where a 2/3 vote is called for. He also <br />pointed out that since he has been on the Council, there has been two periods of time <br />when a 2/3 vote of the Council was four votes, which is a majority. He believes this is <br />an unnecessary clause and will vote against it. <br /> <br />The roll call vote was as follows: AYES: Mr. Ware, Mr. Wagner. NAYS: Mr. Munkel, Mr. <br />Lieberman, Mr. Schoomer, Mr. Sharpe, Mayor Adams. Bill No. 8378 was defeated. <br /> <br />BILL NO. 8379 - AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br />UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING SECTION 34-40.1 <br />THEREOF, RELATING TO PLANNED DEVELOPMENT DISTRICTS-INTENT AND <br />PURPOSE, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN <br />AS "SECTION 34-40.1. INTENT AND PURPOSE," THEREBY AMENDING SAID <br />SECTION SO AS TO STATE THE INTENT REGARDING COMPATIBILITY WITH <br />ABUTTING RESIDENTIAL NEIGHBORHOODS; CONTAINING A SAVING CLAUSE <br />AND PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Wagner moved adoption. Mr. Schoomer seconded the motion. <br /> <br />Mr. Munkel believes this is an unnecessary bill and redundant. He pointed out section <br />34-123, which states the purpose of our zoning ordinance. Secondly, in Section 1, he <br />finds the language vague regarding compatibility with abutting residential <br />neighborhoods. He believes this can cause confusion and problems for the City and <br />urges Council to vote against this. <br /> <br />Mr. Wagner said the Plan Commission discussed this at length and approved it. <br /> <br />Mr. Schoomer said that before we put something in this restrictive, the definitions and <br />guidelines of section four need to be much clearer. <br /> <br />Mr. Lieberman said that from the Plan Commission, that all this does is add the term <br />"including abutting residential neighborhoods". What is already in the code says that <br /> <br /> <br />
