Session 1718, Minutes <br />March 30, 1998 <br /> <br />19 <br /> <br />the planned development regulations are not intended to allow excessive densities or <br />for the development of incompatible land uses, either within the development or as the <br />development relates to the general neighborhood. <br /> <br />Mr. Munkel has a fear that this would place restrictions on development in our <br />community. <br /> <br />Mr. Sharpe thinks we have to be very careful how this is worded. This could be <br />perceived as a red flag. <br /> <br />Mr. Schoomer would really like to look at consideration of a provision that might provide <br />a fixed limit of variance and a definition of percentages of variance within the <br />neighborhood. <br /> <br />Mr. Ware agrees that we should come up with some definitive definitions because using <br />this terminology, compatibility, abutting residential neighborhoods, you can make out of <br />it anything you want. <br /> <br />Mr. Wagner said that the language is already there. We are talking about adding <br />abutting residential neighborhoods. <br /> <br />The roll call vote was as follows: AYES: Mr. Wagner. NAYS: Mr. Munkel, Mr. <br />Lieberman, Mr. Schoomer, Mr. Sharpe, Mr. Ware, Mayor Adams. Bill No. 8379 was <br />defeated. <br /> <br />BILL NO. 8380 - AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br />UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING SECTION 34-162.4 <br />THEREOF, RELATING TO ZONING CODE AMENDMENTS - CITY COUNCIL <br />ACTION, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 34-162.4. CITY COUNCIL ACTION," THEREBY AMENDING SAID <br />SECTION SO AS TO REQUIRE THAT ANY PETITION AGAINST A PROPOSED <br />AMENDMENT BE FILED NO LATER THAN 5:00 P.M. OF THE DAY OF THE <br />SCHEDULED PUBLIC HEARING; CONTAINING A SAVING CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Ollendorff said that the City Attorney agrees that this is a good clarification to make. <br /> <br /> <br />
