Session 1718, Minutes <br />March 30, 1998 <br /> <br />planned protection of designated existing trees; all prior conditions not precisely <br />amended to continue in force; approved drainage plans; odor and smoke exhaust <br />controls; lighting and landscaping adjacent to Barby residences conforming to written <br />agreements; Barby Lane traffic regulations by City to meet traffic study <br />recommendations; south wall treatment subject to further study; construction phase <br />parking plan instituted by applicant and enforced by City. Further plan revisions <br />intended to provide greater neighborhood compatibility are being considered by the City <br />and the applicant. All revisions will comply with the conditions. Final Council action <br />normally occurs following rezoning ordinance adoption. <br /> <br />Ms. Nancy Holekamp, 19 Willow Hill, asked that when it came time to vote on the <br />conditional use permit that she would like to remind the Council that they have a perfect <br />opportunity for compromise as it regards to the south property line, in that University <br />City can still get tax dollars from the Gatesworth. The Gatesworth can develop their <br />property as they see fit and we do not need to lose $35,000 in their property value. If <br />Council does decide to approve the conditional use permit, as it stands now, then at <br />this public forum, she would like to request that Council submit facts of finding and <br />conclusions of law, prior to the decision, to substantiate the reasons, so it can be <br />reviewed at a later date at a court of law or a court of equity. <br /> <br />Ms. Ann Byrnes, 18 Willow Hill, said that the biggest problem that the residents have <br />had with the Gatesworth is the inadequate parking. Ms. Byrnes said that the letter she <br />sent Council itemized proposed parking and itemizing code required parking. As she <br />understands, there is still this thought that the proper amount of parking is being <br />supplied. She does not see the required parking. A certain number of spaces in the <br />enclosed parking area are for compact cars. City code requires that compact spaces <br />can only be used in excess of minimum requirements. The elderly exception is fine, but <br />they do have to have the space available on the property for future conversion. They <br />have no excess green area. She wanted a commitment from Council that someone <br />would contact her to address the parking question. Mayor Adams assured her that the <br />issue would be addressed. <br /> <br />Mr. David Freeman, 8644 Barby Ln., said that people are not counting the parking that <br />takes place on McKnight Place itself, in between Barby and West Kingsbury. He <br />wished to make sure that the agreements between the subdivision and the City are <br />made part of the conditional use permit. <br /> <br />Ms. Lana Weinbach, 8720 West Kingsbury, said that they want to see very dense <br />landscape around the perimeters, such as blue spruce. The white pines have not done <br />well and have not been maintained. They want to know exactly which trees have been <br />earmarked for preservation. There is no consideration for safety factors with respect to <br />children going down the intense slope and drop off. An aesthetic brick wall would be <br /> <br /> <br />
