Session 1719, Minutes <br />April 13, 1998 <br /> <br />Councilmember to #19 Willow Hill, to see the damage that the expansion of the <br />Gatesworth would have on their property and, to her knowledge, only Mr. Wagner had <br />done this. Ms. Holekamp said that it would be necessary to journey to Willow Hill in <br />order to properly address the concerns of the Willow Hill neighborhood for this <br />expansion. In both a letter and at the public hearing, she provided each <br />Councilmember and each zoning member with a letter stating that there would be a <br />$35,000 property loss which she felt constituted significant detriment. For the record, <br />she reminded Council that at the public hearing on March 30th , she requested that <br />Council provide facts of finding and conclusions of law prior to the decision on the <br />conditional use permit so that it could be evaluated in a court of law or a court of equity <br />at a future date. She told Council that if they approve this with the current setback, they <br />plan to go to the Board of Adjustment. She said that the owner of the Gatesworth's <br />private home also does not meet a rear yard setback requirement. She said if they fail <br />their appeal to the Board of Adjustment, they will sue the City Council. <br /> <br />A.J. Chivetta, #35 Loren Woods, said that this expansion is being looked at under the <br />light of a very old comprehensive plan and with poor planning. He said Council was in <br />a unique position in pondering whether to allow a commercial multi family office building <br />to creep into a zoned single residential neighborhood. He felt, though, that to allow it <br />was not necessarily good planning and robs the expectancy of the neighbors living <br />there of the character of their neighborhood. He stated for the record, that the Planning <br />Commission did not care very much about the impact on Ladue, so he is asking Council <br />to consider the impact on the existing neighborhoods in University City as well as in <br />Ladue. He recommends that the Council postpones any rezoning from single <br />residential use until the City has a chance to look at its long range plan. <br /> <br />Ann Byrnes, 18 Willow Hill Rd., said that if the Council votes approval of the rezoning, <br />then it will be even easier to slip in the conditional use permit. She does not believe the <br />rezoning is at all adaptable. She mentioned that the Plan Commission minutes were <br />not correct. This means the Council's information is in error. She said that the new <br />expansion was less than one-fifth of the size of the present Gatesworth, and pointed <br />out that this could not represent a very large amount in revenue. She asked that the <br />second and third readings be tabled until a later time. <br /> <br />Ms. Lana Weinbach, 8720 W. Kingsbury, requested that Council simply vote against <br />the rezoning. If not that, then she requested that Council table the vote for rezoning <br />until a later date. There is a definite link between the conditional use permit and the <br />rezoning. There is still too many questions that have been unanswered and not <br />investigated with respect to the conditional use permit. Since amendments proposed to <br />the zoning code will be discussed at the May 4th Council meeting, she did not believe it <br />would be proper to approve rezoning until these were finalized. The bill should be <br />tabled. She said that there were gross inaccuracies in the approved planning <br /> <br /> <br />
