Session 1719, Minutes
April 13, 1998

commission minutes from the February 25th meeting. The rezoning will be injurious to
the adjacent properties. The revenue expected from the expansion is being over
estimated since the addition will only add to the $340,000 tax dollars already being
received. Ms. Weinbach said that she was also concerned because the City's attorney,
in regards to zoning matters, Shu Simon, had worked for the Gatesworth owners, in the
past, in a matter directly affecting the Gatesworth. She feels some investigation is in
order, prior to a vote taken on this bill.

Mr. Douglas Baron, #10 South Broadway, said that there was not anything new that he
would like to add, but offered his assistance if any questions were required of him.

BILL NO. 8381 - AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE
CITY OF UNIVERSITY CITY, MISSOURI, RELATING TO ZONING BY REPEALING
THE OFFICIAL ZONING MAP ILLUSTRATING THE ZONING DISTRICTS
ESTABLISHED PURSUANT TO SECTION 34-22 THEREOF, AND ENACTING IN LIEU
THEREOF A NEW OFFICIAL ZONING MAP, THEREBY AMENDING SAID MAP SO
AS TO CHANGE THE CLASSIFICATION OF PROPERTY AT 8638 BARBY LANE AND
8640, 8644, 8645, 8648, 8649, 8653 AND 8656 WEST KINGSBURY AVENUE FROM
SINGLE-FAMILY RESIDENTIAL DISTRICT ("SR") TO HIGH DENSITY
RESIDENTIAL/OFFICE DISTRICT ("HRO"); CONTAINING A SAVING CLAUSE AND
PROVIDING A PENALTY.

The bill was given its second reading.
The bill was given its third reading.

Mr. Wagner said that very serious allegations were raised that should be looked into.
He asked to postpone the vote on this bill, until sometime in the future, so these
charges could be looked into.

Mr. Wagner moved to table bill #8381. Mr. Sharpe seconded the motion. Mr. Wagner
and Mr. Sharpe voted Aye, the remainder of Council voted Nay. The motion failed five
to two.

Mr. Schoomer believed the findings of the Plan Commission, City staff and Council are
in order and moved the adoption of bill #8381. Mr. Munkel seconded the motion. The
roll call vote was as follows: AYES: Mr. Ware, Mr. Munkel, Mr. Lieberman, Mr.
Schoomer and Mayor Adams. NAYS: Mr. Wagner, Mr. Sharpe. Bill No. 8381 became
Ordinance No. 6162.
