Session 1935
September 27, 2004

issuance of this license.

Property Vacation Public Hearinq - 9009-9011 Old Bonhomme

Mr. Ollendorff recommended setting October 11 at 7:30 p.m. in these Council
Chambers as the time and place for a public hearing on the requested vacating of public
right-of-way north of Old Bonhomme between 9009 and 9011. This property is
unimproved except for a gravel base and is utilized as a private shared driveway by
these two adjacent owners.

Mr. Wagner moved adoption of the Consent Calendar. Mr. Sharpe seconded the
motion, which passed unanimously.

Agenda Item #2 - Public Hearinq on Political Signs

A public hearing has been requested on political signs. The next possible time for such
a hearing would be October 11 at 7:30 p.m. in these Council Chambers. Since the sign
rules are part of the Zoning Ordinance, City Council will be required to hold another
public hearing following the Plan Commission review and recommendation.

Ms. Welsch moved approval and Ms. Brungardt seconded. Ms. Brot expressed her
support for holding this public hearing as a means to obtain citizen in-put on two
particular aspects of the matter, in order to clarify: 1) freedom of speech issues in the
ordinance and 2) determining a more consistent, specific and equitable procedures for
enforcement. She favors public listing of signs which are removed by the City and
providing the reasons for doing so and she wants candidates to be better informed
about City Ordinances. She will submit her ideas in writing. The motion passed
unanimously.

Agenda Item #3 -Surplus Property Sale - Trenton Avenue

The City Manager recommended selling an unbuildable parcel 25' x 140' on the north
side of Trenton Avenue adjacent to 1559 78th Street. This 25' strip is surplus and not
needed now or in the future for public purposes. It would be best utilized as an addition
to the adjacent lot which would relieve the city of any future liability plus place its value
back on the tax rolls. The adjacent owner wishes to acquire this small lot in order to
accommodate a fence and to improve maintenance. Disposal should be by a deed
drawn up by the City Attorney in exchange for payment of a token $10.00 fee.

Ms. Colquitt moved approval and Mr. Sharpe seconded.

Ms. Welsch asked if the right of easements or future needs for utilities would be
maintained in case they are needed in the future, and Mr. Ollendorff said he would
make it a condition in the deed and bring it to the attention of the City Attorney.
