Regular Session 1941 <br />December 6, 2004 <br /> <br />Mr. Wagner said based upon the number of points raised by Mr. Harig, which need to <br />be discussed further by the City Council, especially the potential procedural error in the <br />administrative process and the potential litigation for either side of the argument, he <br />moved to delay the vote again, until after the forthcoming study session. Ms. Brot <br />seconded the motion. <br /> <br />Mayor Adams asked that a second reading occur so that the third reading could be <br />delayed. <br /> <br />The Bill was read for a second time. <br /> <br />Mayor Adams asked if it was the consensus of the Council to delay the third reading <br />and a "nodding of heads" indicated that it was. He then said he would ask Mr. Wagner <br />a question privately and that would determine additional statements and there would not <br />be a third reading tonight. <br /> <br />Mr. Ollendorff said the Plat meets all of the City Ordinance requirements and regardless <br />of what evolves from the Study Session discussion, the City administration will make <br />sure there are proposals to resolve the drainage issues. There are ways to work with <br />both the property owners and with MSD to solve the run-off problems. That will occur <br />regardless of what happens regarding the Plat. If the Plat is approved and the project <br />moves forward the City will make sure that parking and access during construction is <br />regulated by the City and the City will repair the private street after construction to <br />compensate for any damage. This statement is for the record while citizens are present. <br /> <br />3. BILL NO. 8749 - VACATING AND SURRENDERING PORTION OF <br />RIGHT-OF-WAY OR LEPERE AVENUE LOCATED NORTH OF OLD <br />BONHOMME ROAD AND AN ADJACENT PORTION OF RIGHT-OF-WAY OF <br />AN ALLEY EXTENDING WESTWARD FROM THE NORTH TERMINUS OF LE <br />PERE AVENUE TO THE WEST CITY LIMITS OF UNIVERSITY CITY, BUT <br />RESERVING ANY PUBLIC EASEMENTS IF ANY AND DIRECTING THAT THIS <br />ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF <br />DEEDS OF SAINT LOUIS COUNTY, MISSOURI. <br /> <br />This Bill was read for the second time. <br />This Bill was read for the third time. <br /> <br />Ms. Welsch moved approval and Ms. Brot seconded. The roll call vote was as <br />follows: AYES: Ms. Brungardt, Mr. Wagner, Ms. Brot, Ms. Welsch, Mr. Sharpe, <br />Ms. Colquitt and Mayor Adams; NAYS: none.
